Senator Fasano moved the following:
1 Senate Amendment (with title amendment)

3 Delete lines 1794 - 1807
4 and insert:
5 (5) Each person shall maintain a record that contains which
6 shall contain a detailed list of controlled substances lost,
7 destroyed, or stolen, if any; the kind and quantity of such
8 controlled substances; and the date of the discovering of such
9 loss, destruction, or theft. If a person discovers the theft or
10 significant loss of a controlled substance, such person shall
11 report the theft or significant loss to a local county sheriff’s
12 office within 48 hours after the discovery of such theft or
13 loss. A person who fails to report the theft or significant loss
14 of a controlled substance under this subsection commits a
15 misdemeanor of the second degree, punishable as provided in s.
16 775.082 or s. 775.083. However, a person who fails to report the
17 theft or loss of a Schedule II controlled substance commits a
18 misdemeanor of the first degree, punishable as provided in s.
19 775.082 or s. 775.083.

24 and insert:
25 amending s. 893.07, F.S.; requiring that a person
26 report to the local sheriff’s office the theft or
27 significant loss of a controlled substance within a
28 specified time;
