       Senator Bogdanoff moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 1791 - 1810
    4  and insert:
    5  substances. This subsection requires a law enforcement officer
    6  to obtain a subpoena, court order, or search warrant in order to
    7  obtain access to or copies of such records.
    8         (5) Each person shall maintain a record that contains which
    9  shall contain a detailed list of controlled substances lost,
   10  destroyed, or stolen, if any; the kind and quantity of such
   11  controlled substances; and the date of the discovering of such
   12  loss, destruction, or theft. If a person discovers the theft or
   13  loss of a controlled substance, such person shall report the
   14  theft or loss to a local county sheriff’s office within 48 hours
   15  after the discovery of such theft or loss. A person who fails to
   16  report the theft or loss of a controlled substance under this
   17  subsection commits a misdemeanor of the second degree,
   18  punishable as provided in s. 775.082 or s. 775.083. However, a
   19  person who fails to report the theft or loss of a Schedule II
   20  controlled substance commits a misdemeanor of the first degree,
   21  punishable as provided in s. 775.082 or s. 775.083.
   22         (6) The Legislature finds that the opinions rendered in
   23  State v. Carter, 23 So. 3d 798 (Fla. 1st DCA 2009), and State v.
   24  Tamulonis, 39 So. 3d 524 (Fla. 2nd DCA 2010), do not correctly
   25  construe
