       The Committee on Governmental Oversight and Accountability
       (Fasano) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 96 and 97
    4  insert:
    5         Section 4. Paragraphs (a) and (c) of subsection (8) of
    6  section 112.3215, Florida Statutes, are amended, present
    7  subsection (14) of that section is redesignated as subsection
    8  (15), and a new subsection (14) is added to that section, to
    9  read:
   10         112.3215 Lobbying before the executive branch or the
   11  Constitution Revision Commission; registration and reporting;
   12  investigation by commission.—
   13         (8)(a) The commission shall investigate every sworn
   14  complaint that is filed with it alleging that a person covered
   15  by this section has failed to register, has failed to submit a
   16  compensation report, has made a prohibited expenditure, or has
   17  knowingly submitted false information in any report or
   18  registration required in this section.
   19         (c) The commission shall investigate any lobbying firm,
   20  lobbyist, principal, agency, officer, or employee upon receipt
   21  of information from a sworn complaint or from a random audit of
   22  lobbying reports indicating a possible violation other than a
   23  late-filed report.
   24         (14) Any person who is required to be registered or to
   25  provide information under this section or under rules adopted
   26  pursuant to this section and who knowingly fails to disclose any
   27  material fact that is required by this section or by rules
   28  adopted pursuant to this section, or who knowingly provides
   29  false information on any report required by this section or by
   30  rules adopted pursuant to this section, commits a noncriminal
   31  infraction, punishable by a fine not to exceed $5,000. This fine
   32  is in addition to any other penalty assessed by the Governor and
   33  Cabinet pursuant to subsection (10).

   36         And the title is amended as follows:
   37         Delete line 26
   38  and insert:
   39         legislator is a member; amending s. 112.3215, F.S.;
   40         revising the requirements that the commission
   41         investigate certain complaints to include complaints
   42         against a certain act or certain entities; providing
   43         that a person who is required to register with the
   44         Constitution Revision Commission or to provide
   45         information on a report required by the commission but
   46         who fails to disclose material fact or provides false
   47         information commits a noncriminal infraction;
   48         providing a fine for such infraction; providing an
   49         effective date.
