Floor: 1/AD/2R . 04/29/2011 09:29 AM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Gaetz moved the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 59 - 77 4 and insert: 5 (4)(a) On or after July 1, 2011, a unit of government that 6 enters into a contract or employment agreement, or the renewal 7 or renegotiation of an existing contract or employment 8 agreement, which contains a provision for severance pay with an 9 officer, agent, employee, or contractor, must include the 10 following provisions in the contract: 11 1. A requirement that severance pay provided may not exceed 12 an amount greater than 6 weeks of compensation. 13 2. A prohibition against the provision of severance pay if 14 the officer, agent, employee, or contractor has been fired for 15 misconduct, as defined in s. 443.036, or for other cause by the 16 unit of government. 17 (b) On or after July 1, 2011, an officer, agent, employee, 18 or contractor may receive severance pay not provided for in a 19 contract or employment agreement if the severance pay represents 20 the settlement of an employment dispute. Such severance pay may 21 not exceed an amount greater than 6 weeks of compensation. The 22 settlement may not include provisions that limit the ability of 23 any party to the settlement to discuss the dispute or 24 settlement. 25 26 ================= T I T L E A M E N D M E N T ================ 27 And the title is amended as follows: 28 Delete lines 6 - 9 29 and insert: 30 the conditions for paying bonuses; requiring contracts 31 that provide for severance pay to include certain 32 provisions after a certain date; allowing for 33 severance pay under specified circumstances; defining 34 the term “severance pay”;
