The Committee on Health Regulation (Fasano) recommended the
following:

6 Section 3. Paragraph (c) of subsection (15) of section
7 499.0121, Florida Statutes, is amended to read:
8 499.0121 Storage and handling of prescription drugs;
9 recordkeeping.—The department shall adopt rules to implement
10 this section as necessary to protect the public health, safety,
11 and welfare. Such rules shall include, but not be limited to,
12 requirements for the storage and handling of prescription drugs
13 and for the establishment and maintenance of prescription drug
14 distribution records.
15 (15) DUE DILIGENCE OF PURCHASERS.—
16 (c) A wholesale distributor shall review documentation of
17 the receiving entity’s state and federal licenses and permits
18 before distributing a controlled substance to that entity. A
19 wholesale distributor may not distribute controlled substances
20 to an entity without verification of the required state and
21 federal licenses and permits if any criminal history record
22 check for any person associated with that entity shows that the
23 person has been convicted of, or entered a plea of guilty or
24 nolo contendere to, regardless of adjudication, a crime in any
25 jurisdiction related to controlled substances, the practice of
26 pharmacy, or the dispensing of medicinal drugs.
