    1                        A bill to be entitled                      
    2         An act relating to postsecondary student fees;
    3         providing an exemption from payment of nonresident
    4         tuition at a state university or a Florida College
    5         System institution for a student who meets specified
    6         requirements; requiring that the Board of Governors of
    7         the State University System adopt regulations and the
    8         State Board of Education adopt rules; providing an
    9         effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Nonresident tuition exemption.—
   14         (1) Beginning with the 2012 fall term, a student, other
   15  than a nonimmigrant alien within the meaning of 8 U.S.C. s.
   16  1101(a)(15), is exempt from paying nonresident tuition at a
   17  state university or a Florida College System institution if the
   18  student:
   19         (a) Attended high school in the state for 3 or more
   20  consecutive or nonconsecutive years;
   21         (b) Graduated from a high school in the state or attained a
   22  high school equivalency diploma pursuant to s. 1003.435, Florida
   23  Statutes;
   24         (c) Registered as an entering student or is currently
   25  enrolled at a state university or a Florida College System
   26  institution; and
   27         (d) In the case of a student without lawful immigration
   28  status, files an affidavit with the state university or the
   29  Florida College System institution stating that the student has
   30  filed an application to legalize his or her immigration status
   31  or will file an application as soon as he or she is eligible to
   32  do so.
   33         (2) The Board of Governors shall adopt regulations and the
   34  State Board of Education shall adopt rules to administer this
   35  section.
   36         Section 2. This act shall take effect July 1, 2012.
