       Senator Hays moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 35 and 36
    4  insert:
    5         Section 2. Subsection (5) of section 479.11, Florida
    6  Statutes, is amended to read:
    7         479.11 Specified signs prohibited.—No sign shall be
    8  erected, used, operated, or maintained:
    9         (5)(a) Which displays intermittent lights not embodied in
   10  the sign, or any rotating or flashing light within 100 feet of
   11  the outside boundary of the right-of-way of any highway on the
   12  State Highway System, interstate highway system, or federal-aid
   13  primary highway system or which is illuminated in such a manner
   14  so as to cause glare or to impair the vision of motorists or
   15  otherwise distract motorists so as to interfere with the
   16  motorists’ ability to safely operate their vehicles.
   17         (b) If the sign is on the premises of an establishment as
   18  provided in s. 479.16(1), in which case the local government
   19  authority with jurisdiction over the location of the sign shall
   20  enforce the provisions of this section as provided in chapter
   21  162 and this section.
