Paragraph (b) of subsection (1) of section 6 101.043, Florida Statutes, is amended, and paragraph (d) is 7 added to that subsection, to read: 8 101.043 Identification required at polls.— 9 (1) 10 (b) If the picture identification does not contain the 11 signature of the elector, an additional identification that 12 provides the elector’s signature shall be required. The address 13 appearing on the identification presented by the elector may not 14 be used as the basis toconfirm an elector’s legal residence or15otherwisechallenge an elector’s legal residence. The elector 16 shall sign his or her name in the space provided on the precinct 17 register or on an electronic device provided for recording the 18 elector’s signature. The clerk or inspector shall compare the 19 signature with that on the identification provided by the 20 elector and enter his or her initials in the space provided on 21 the precinct register or on an electronic device provided for 22 that purpose and allow the elector to vote if the clerk or 23 inspector is satisfied as to the identity of the elector. 24 (d) If the elector produces a valid picture identification 25 card, the elector may refuse to allow or decline a request from 26 a clerk or inspector to swipe the picture identification card 27 through an electronic voter identification system or to access 28 by any means the information encoded on the card. If the elector 29 communicates such a refusal or declination, the clerk or 30 inspector must honor the elector’s choice and not swipe the 31 picture identification card through an electronic voter 32 identification system or access by any means the information 33 encoded on the card. 34 35 ================= T I T L E A M E N D M E N T ================ 36 And the title is amended as follows: 37 Delete line 2 38 and insert: 39 An act relating to elections; amending s. 101.043, 40 F.S.; removing a provision prohibiting the use of the 41 address appearing on the identification presented by 42 an elector as a basis for confirming the elector’s 43 legal residence; authorizing an elector to refuse to 44 allow or decline a request from the clerk or inspector 45 to swipe a valid identification card through an 46 electronic voter identification system or use other 47 means to access information encoded on the 48 identification card; requiring the clerk or the 49 inspector to honor the elector’s decision; amending s.
