House Comm: RCS . 02/16/2012 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Criminal Justice (Hays) recommended the following: 1 Senate Amendment (with directory and title amendments) 2 3 Between lines 164 and 165 4 insert: 5 (f) The portion of the tax imposed by paragraph (1)(g) 6 which results from the collection of fuel sales tax paid by a 7 county sheriff’s office for fuel used in motor vehicles operated 8 by the sheriff’s office shall be returned to the sheriff’s 9 office. The sheriff’s office shall use the proceeds to offset 10 ongoing fuel costs. A sheriff’s office, if licensed as a local 11 government user, may take a credit on the monthly diesel fuel 12 tax return not to exceed the tax imposed under paragraphs (1)(b) 13 and (g) on those gallons which would otherwise be eligible for 14 refund. 15 Section 3. Subsection (3) is added to section 206.625, 16 Florida Statutes, to read: 17 206.625 Return of tax to municipalities, counties, and 18 school districts.— 19 (3) Those portions of the county fuel tax imposed by s. 20 206.41(1)(b) which result from the collection of the taxes paid 21 by a county sheriff’s office for fuel used in motor vehicles 22 operated by the sheriff’s office shall be returned to the 23 sheriff’s office.
