A bill to be entitled
2An act relating to public school student participation
3in fine arts courses; amending s. 1008.34, F.S.;
4revising the basis for the designation of school
5grades to include the participation rate of students
6who are enrolled in fine arts courses; correcting
7terminology; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:
10
11     Section 1.  Paragraphs (b) and (c) of subsection (3) of
12section 1008.34, Florida Statutes, are amended to read:
13     1008.34  School grading system; school report cards;
14district grade.-
15     (3)  DESIGNATION OF SCHOOL GRADES.-
16     (b)1.  A school's grade shall be based on a combination of:
17     a.  Student achievement scores, including achievement on
18all FCAT assessments administered under s. 1008.22(3)(c)1., end-
19of-course assessments administered under s. 1008.22(3)(c)2.a.,
20and achievement scores for students seeking a special diploma.
21     b.  Student learning gains in reading and mathematics as
22measured by FCAT and end-of-course assessments, as described in
23s. 1008.22(3)(c)1. and 2.a. Learning gains for students seeking
24a special diploma, as measured by an alternate assessment tool,
25shall be included not later than the 2009-2010 school year.
26     c.  Improvement of the lowest 25th percentile of students
27in the school in reading and mathematics on the FCAT or end-of-
28course assessments described in s. 1008.22(3)(c)2.a., unless
29these students are exhibiting satisfactory performance.
30     2.  Beginning with the 2011-2012 school year, for schools
31comprised of middle school grades 6 through 8 or grades 7 and 8,
32the school's grade shall include the performance and
33participation of its students enrolled in high school level
34courses with end-of-course assessments administered under s.
351008.22(3)(c)2.a. Performance and participation must be weighted
36equally. As valid data becomes available, the school grades
37shall include the students' attainment of national industry
38certification identified in the Industry Certification Funding
39List pursuant to rules adopted by the State Board of Education.
40     3.  Beginning with the 2009-2010 school year for schools
41comprised of high school grades 9, 10, 11, and 12, or grades 10,
4211, and 12, 50 percent of the school grade shall be based on a
43combination of the factors listed in sub-subparagraphs 1.a.-c.
44and the remaining 50 percent on the following factors:
45     a.  The high school graduation rate of the school;
46     b.  As valid data becomes available, the performance and
47participation of the school's students in College Board Advanced
48Placement courses, International Baccalaureate courses, dual
49enrollment courses, and Advanced International Certificate of
50Education courses; and the students' achievement of national
51industry certification identified in the Industry Certification
52Funding List, pursuant to rules adopted by the State Board of
53Education;
54     c.  Postsecondary readiness of the school's students as
55measured by the SAT, ACT, or the common placement test;
56     d.  The high school graduation rate of at-risk students who
57scored at Level 2 or lower on the grade 8 FCAT Reading and
58Mathematics examinations;
59     e.  As valid data becomes available, the performance of the
60school's students on statewide standardized end-of-course
61assessments administered under s. 1008.22(3)(c)2.c. and d.; and
62     f.  The growth or decline in the components listed in sub-
63subparagraphs a.-e. from year to year.
64     4.  Beginning with the 2012-2013 school year, for schools
65comprised of any of grades kindergarten through grade 12, the
66school's grade shall include the participation rate of students
67who are enrolled in fine arts courses, which are visual arts,
68music, dance, and theatre.
69     (c)  Student assessment data and participation rates used
70in determining school grades shall include:
71     1.  The aggregate scores of all eligible students enrolled
72in the school who have been assessed on the FCAT and statewide,
73standardized end-of-course assessments in courses required for
74high school graduation, including, beginning with the 2010-2011
75school year, the end-of-course assessment in Algebra I; and
76beginning with the 2011-2012 school year, the end-of-course
77assessments in geometry and Biology; and beginning with the
782013-2014 school year, on the statewide, standardized end-of-
79course assessment in civics education at the middle school
80level.
81     2.  The aggregate scores of all eligible students enrolled
82in the school who have been assessed on the FCAT and end-of-
83course assessments as described in s. 1008.22(3)(c)2.a., and who
84have scored at or in the lowest 25th percentile of students in
85the school in reading and mathematics, unless these students are
86exhibiting satisfactory performance.
87     3.  The achievement scores and learning gains of eligible
88students attending alternative schools that provide dropout
89prevention and academic intervention services pursuant to s.
901003.53. The term "eligible students" in this subparagraph does
91not include students attending an alternative school who are
92subject to district school board policies for expulsion for
93repeated or serious offenses, who are in dropout retrieval
94programs serving students who have officially been designated as
95dropouts, or who are in programs operated or contracted by the
96Department of Juvenile Justice. The student performance data for
97eligible students identified in this subparagraph shall be
98included in the calculation of the home school's grade. As used
99in this subparagraph and s. 1008.341, the term "home school"
100means the school to which the student would be assigned if the
101student were not assigned to an alternative school. If an
102alternative school chooses to be graded under this section,
103student performance data for eligible students identified in
104this subparagraph shall not be included in the home school's
105grade but shall be included only in the calculation of the
106alternative school's grade. A school district that fails to
107assign the FCAT and end-of-course assessment as described in s.
1081008.22(3)(c)2.a. scores of each of its students to his or her
109home school or to the alternative school that receives a grade
110shall forfeit Florida School Recognition Program funds for 1
111fiscal year. School districts must require collaboration between
112the home school and the alternative school in order to promote
113student success. This collaboration must include an annual
114discussion between the principal of the alternative school and
115the principal of each student's home school concerning the most
116appropriate school assignment of the student.
117     4.  The achievement scores and learning gains of students
118who are hospitalized designated as hospital- or homebound.
119Student assessment data for students who are hospitalized
120designated as hospital- or homebound shall be assigned to their
121home school for the purposes of school grades. As used in this
122subparagraph, the term "home school" means the school to which a
123student would be assigned if the student were not assigned to a
124hospital/homebound hospital- or homebound program.
125     5.  For schools comprised of high school grades 9, 10, 11,
126and 12, or grades 10, 11, and 12, the data listed in
127subparagraphs 1.-3. and the following data as the Department of
128Education determines such data are valid and available:
129     a.  The high school graduation rate of the school as
130calculated by the Department of Education;
131     b.  The participation rate of all eligible students
132enrolled in the school and enrolled in College Board Advanced
133Placement courses; International Baccalaureate courses; dual
134enrollment courses; Advanced International Certificate of
135Education courses; and courses or sequences of courses leading
136to national industry certification identified in the Industry
137Certification Funding List, pursuant to rules adopted by the
138State Board of Education;
139     c.  The aggregate scores of all eligible students enrolled
140in the school in College Board Advanced Placement courses,
141International Baccalaureate courses, and Advanced International
142Certificate of Education courses;
143     d.  Earning of college credit by all eligible students
144enrolled in the school in dual enrollment programs under s.
1451007.271;
146     e.  Earning of a national industry certification identified
147in the Industry Certification Funding List, pursuant to rules
148adopted by the State Board of Education;
149     f.  The aggregate scores of all eligible students enrolled
150in the school in reading, mathematics, and other subjects as
151measured by the SAT, the ACT, and the common placement test for
152postsecondary readiness;
153     g.  The high school graduation rate of all eligible at-risk
154students enrolled in the school who scored at Level 2 or lower
155on the grade 8 FCAT Reading and Mathematics examinations;
156     h.  The performance of the school's students on statewide
157standardized end-of-course assessments administered under s.
1581008.22(3)(c)2.c. and d.; and
159     i.  The growth or decline in the data components listed in
160sub-subparagraphs a.-h. from year to year.
161     6.  Beginning with the 2012-2013 school year, for schools
162comprised of any of grades kindergarten through grade 12, the
163participation rate of students in the school who are enrolled in
164fine arts courses, which are visual arts, music, dance, and
165theatre.

167The State Board of Education shall adopt appropriate criteria
168for each school grade. The criteria must also give added weight
169to student achievement in reading. Schools designated with a
170grade of "C," making satisfactory progress, shall be required to
171demonstrate that adequate progress has been made by students in
172the school who are in the lowest 25th percentile in reading and
173mathematics on the FCAT and end-of-course assessments as
174described in s. 1008.22(3)(c)2.a., unless these students are
175exhibiting satisfactory performance. Beginning with the 2009-
1762010 school year for schools comprised of high school grades 9,
17710, 11, and 12, or grades 10, 11, and 12, the criteria for
178school grades must also give added weight to the graduation rate
179of all eligible at-risk students, as defined in this paragraph.
180Beginning in the 2009-2010 school year, in order for a high
181school to be designated as having a grade of "A," making
182excellent progress, the school must demonstrate that at-risk
183students, as defined in this paragraph, in the school are making
184adequate progress.
185     Section 2.  This act shall take effect July 1, 2012.
