A bill to be entitled
2An act relating to veterinary practice; amending s.
3474.202, F.S.; defining the term "limited service
4veterinary vaccination clinic"; amending s. 474.215,
5F.S.; revising terminology; requiring that the Board
6of Veterinary Medicine establish minimum standards for
7limited service veterinary vaccination clinics rather
8than limited service veterinary medical practices;
9amending ss. 455.2185 and 456.023, F.S.; deleting
10provisions that limit the practice privileges of out-
11of-state or foreign health care professionals or
12veterinarians who are in this state for a specific
13sporting event; providing an effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17     Section 1.  Subsection (6) of section 474.202, Florida
18Statutes, is amended to read:
19     474.202  Definitions.-As used in this chapter:
20     (6)  "Limited-service veterinary vaccination clinic medical
21practice" means a veterinary practice at which a veterinarian
22performs vaccinations or immunizations on multiple animals at a
23temporary location and operates for a limited time offering or
24providing veterinary services at any location that has a primary
25purpose other than that of providing veterinary medical service
26at a permanent or mobile establishment permitted by the board;
27provides veterinary medical services for privately owned animals
28that do not reside at that location; operates for a limited
29time; and provides limited types of veterinary medical services.
30     Section 2.  Subsection (7) of section 474.215, Florida
31Statutes, is amended to read:
32     474.215  Premises permits.-
33     (7)  The board by rule shall establish minimum standards
34for the operation of limited service veterinary vaccination
35clinics medical practices. Such rules shall not restrict limited
36service veterinary medical practices and shall be consistent
37with the type of limited veterinary vaccination and immunization
38services medical service provided.
39     (a)  Any person that offers or provides limited service
40veterinary vaccination clinics medical practice shall obtain a
41biennial permit from the board the cost of which shall not
42exceed $250. The limited service permittee shall register each
43location where a limited service veterinary vaccination clinic
44is held and shall pay a fee set by rule not to exceed $25 to
45register each such location.
46     (b)  All permits issued under this subsection are subject
47to the provisions of ss. 474.213 and 474.214.
48     (c)  Notwithstanding any provision of this subsection to
49the contrary, any temporary rabies vaccination effort operated
50by a county health department in response to a public health
51threat, as declared by the State Health Officer in consultation
52with the State Veterinarian, is not subject to any
53preregistration, time limitation, or fee requirements, but must
54adhere to all other requirements for limited service veterinary
55vaccination clinics medical practice as prescribed by rule. The
56fee charged to the public for a rabies vaccination administered
57during such temporary rabies vaccination effort may not exceed
58the actual cost of administering the rabies vaccine. Such rabies
59vaccination efforts may not be used for any purpose other than
60to address the public health consequences of the rabies
61outbreak. The board shall be immediately notified in writing of
62any temporary rabies vaccination effort operated under this
63paragraph.
64     Section 3.  Subsection (2) of section 455.2185, Florida
65Statutes, is amended to read:
66     455.2185  Exemption for certain out-of-state or foreign
67professionals; limited practice permitted.-
68     (2)  A professional's practice under this section is
69limited to the members, coaches, and staff of the team for which
70that professional is employed or designated and to any animals
71used if the sporting event for which that professional is
72employed or designated involves animals. A professional
73practicing under authority of this section shall not have
74practice privileges in any licensed veterinary facility without
75the approval of that facility.
76     Section 4.  Subsection (2) of section 456.023, Florida
77Statutes, is amended to read:
78     456.023  Exemption for certain out-of-state or foreign
79professionals; limited practice permitted.-
80     (2)  A professional's practice under this section is
81limited to the members, coaches, and staff of the team for which
82that professional is employed or designated and to any animals
83used if the sporting event for which that professional is
84employed or designated involves animals. A professional
85practicing under authority of this section shall not have
86practice privileges in any licensed health care facility or
87veterinary facility without the approval of that facility.
88     Section 5.  This act shall take effect July 1, 2012.
