       Senator Storms moved the following:
       
    1         Senate Amendment (with directory and title amendments)
    2  
    3         Between lines 1306 and 1307
    4  insert:
    5         (5) The department may initiate administrative proceedings
    6  under chapter 120 for an emergency order and issue an emergency
    7  order restricting the license of a health care practitioner
    8  licensed under chapter 458, chapter 459, chapter 461, or chapter
    9  466 from prescribing controlled substances, as defined in
   10  chapter 893, if the licensee:
   11         (a) Is arrested for, is criminally prosecuted for, or
   12  commits, any act that is a violation of chapter 782;
   13         (b) Is arrested for, or is criminally prosecuted for, any
   14  act that directly relates to the importation, manufacture,
   15  distribution, possession, transfer, sale, or prescribing of
   16  controlled substances as defined in chapter 893; or
   17         (c) Violates a provision of 21 U.S.C. ss. 801-971, relating
   18  to the possession, transfer, sale, or prescribing of controlled
   19  substances.
   20         Section 14. Paragraph (m) is added to subsection (2) of
   21  section 903.046, Florida Statutes, to read:
   22         903.046 Purpose of and criteria for bail determination.—
   23         (2) When determining whether to release a defendant on bail
   24  or other conditions, and what that bail or those conditions may
   25  be, the court shall consider:
   26         (m) Whether the suspension of a license or the restriction
   27  of the ability to practice a licensed profession as defined in
   28  s. 456.001 is necessary to protect the community against
   29  unreasonable danger from the criminal defendant.
