The Committee on Environmental Preservation and Conservation
(Detert) recommended the following:

4 and insert:

11 (b)1. A county, municipality, or local pollution control
12 program that has a delegation of the environmental resource
13 permit program or proposes to be delegated such authority under
14 s. 373.441 shall without modification incorporate by reference
15 the rules adopted pursuant to this section.
16 2. A county, municipality, or local pollution control
17 program that has a delegation of the environmental resource
18 permit program under s. 373.441 must amend its local ordinances
19 or regulations to incorporate by reference the applicable rules
20 adopted pursuant to this section within 12 months of their
21 effective date.
22 3. Consistent with s. 373.441, nothing contained herein
23 shall be construed to prohibit a county, municipality, or local
24 pollution control program from adopting or implementing
25 regulations that are stricter than those adopted pursuant to
26 this section.
27 4. The Department and each local program with the authority
28 to implement or seeking to implement a delegation of
29 environmental resource permit program authority under s. 373.441
30 shall identify and reconcile any duplicative permitting
31 processes as part of the delegation.
