       The Committee on Health Regulation (Gaetz) recommended the
       following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 60 - 102
    4  and insert:
    5         Section 3. Subsection (2) of section 627.638, Florida
    6  Statutes, is amended to read:
    7         627.638 Direct payment for hospital, medical services.—
    8         (2) Whenever, in any health insurance claim form, an
    9  insured specifically authorizes payment of benefits directly to
   10  any recognized hospital, licensed ambulance provider, physician,
   11  dentist, psychologist, or other person who provided the services
   12  in accordance with the provisions of the policy, the insurer
   13  shall make such payment to the designated provider of such
   14  services. The insurance contract may not prohibit, and claims
   15  forms must provide an option for, the payment of benefits
   16  directly to a licensed hospital, licensed ambulance provider,
   17  physician, dentist, psychologist, or other person who provided
   18  the services in accordance with the provisions of the policy for
   19  care provided. The insurer may require written attestation of
   20  assignment of benefits. Payment to the provider from the insurer
   21  may not be more than the amount that the insurer would otherwise
   22  have paid without the assignment.
