House Comm: WD . 03/01/2012 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Budget Subcommittee on Transportation, Tourism, and Economic Development Appropriations (Bogdanoff) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 1701 - 1748 4 and insert: 5Innovationshall contract with oneor moreconsumer 6 reporting agencyagenciesto provide users with secured 7 electronic access to employer-provided information relating to 8 the quarterly wages report submitted in accordance with the 9 state’s reemployment assistanceunemployment compensationlaw. 10 The access is limited to the wage reports for the appropriate 11 amount of time for the purpose the information is requested. 12 (2) Users must obtain consent in writing or by electronic 13 signature from an applicant for credit, employment, or other 14 permitted purposes. Any written or electronic signature consent 15 from an applicant must be signed and must include the following: 16 (c) Notice that the files of the Department of Economic 17 OpportunityAgency for Workforce Innovationor its tax 18 collection service provider containing information concerning 19 wage and employment history which is submitted by the applicant 20 or his or her employers may be accessed; and 21 (4) If a consumer reporting agency or user violates this 22 section, the Department of Economic OpportunityAgency for23Workforce Innovationshall, upon 30 days’ written notice to the 24 consumer reporting agency, terminate the contract established 25 between the departmentAgency for Workforce Innovationand the 26 consumer reporting agency or require the consumer reporting 27 agency to terminate the contract established between the 28 consumer reporting agency and the user under this section. 29 (5) The Department of Economic OpportunityAgency for30Workforce Innovationshall establish minimum audit, security, 31 net worth, and liability insurance standards, technical 32 requirements, and any other terms and conditions considered 33 necessary in the discretion of the state agency to safeguard the 34 confidentiality of the information released under this section 35 and to otherwise serve the public interest. The department 36Agency for Workforce Innovationshall also include, in 37 coordination with any necessary state agencies, necessary audit 38 procedures to ensure that these rules are followed. 39 (6) In contracting with oneor moreconsumer reporting 40 agencyagenciesunder this section, any revenues generated by 41 the contract must be used to pay the entire cost of providing 42 access to the information.
