Senator Garcia moved the following:
1 Senate Amendment to Amendment (609984) (with title
2 amendment)

4 Between lines 3997 and 3998
5 insert:
6 Section 101. Section 395.1051, Florida Statutes, is amended
7 to read:
8 395.1051 Duty to notify patients.—
9 (1) An appropriately trained person designated by each
10 licensed facility shall inform each patient, or an individual
11 identified pursuant to s. 765.401(1), in person about adverse
12 incidents that result in serious harm to the patient.
13 Notification of outcomes of care that result in harm to the
14 patient under this section shall not constitute an
15 acknowledgment or admission of liability, nor can it be
16 introduced as evidence.
17 (2) A hospital shall notify obstetrical physicians who have
18 privileges at the hospital at least 120 days before the hospital
19 closes an obstetrics department or ceases to provide obstetrical
20 services.

24 Delete line 4332
25 and insert:
26 patient brokering; amending s. 395.1051, F.S.;
27 requiring that a hospital notify obstetrical
28 physicians within a specified period before the
29 hospital closes an obstetrics department or ceases to
30 provide obstetrical services; providing effective
31 dates.
