The Committee on Transportation (Garcia) recommended the
following:
1 Senate Substitute for Amendment (516378) (with title
2 amendment)

4 Delete everything after the enacting clause
5 and insert:
6 Section 1. Paragraph (n) of subsection (1) of section
7 125.01, Florida Statutes, is amended to read:
8 125.01 Powers and duties.—
9 (1) The legislative and governing body of a county shall
10 have the power to carry on county government. To the extent not
11 inconsistent with general or special law, this power includes,
12 but is not restricted to, the power to:
13 (n) Except as provided in s. 125.01035, license and
14 regulate taxis, jitneys, limousines for hire, rental cars, and
15 other passenger vehicles for hire that operate in the
16 unincorporated areas of the county; except that any
17 constitutional charter county as defined in s. 125.011(1) shall
18 on July 1, 1988, have been authorized to have issued a number of
19 permits to operate taxis which is no less than the ratio of one
20 permit for each 1,000 residents of said county, and any such new
21 permits issued after June 4, 1988, shall be issued by lottery
22 among individuals with such experience as a taxi driver as the
23 county may determine.
24 Section 2. Section 125.01035, Florida Statutes, is created
25 to read:
26 125.01035 Passenger vehicles for hire; accepted methods of
27 payment for passenger fares.—
28 (1) As used in this section, the term “payment card” means
29 a credit card, charge card, debit card, or any other card that
30 is issued to an authorized card user and that allows the user to
31 obtain, purchase, or receive goods, services, money, or anything
32 else of value from a merchant.
33 (2) A county may not prohibit the payment of passenger
34 fares for a taxicab, limousine, jitney, or other passenger
35 vehicle for hire by cash, check, or similar method of payment.
36 Section 3. Section 166.0433, Florida Statutes, is created
37 to read:
38 166.0433 Passenger vehicles for hire; accepted methods of
39 payment for passenger fares.—
40 (1) As used in this section, the term “payment card” means
41 a credit card, charge card, debit card, or any other card that
42 is issued to an authorized card user and that allows the user to
43 obtain, purchase, or receive goods, services, money, or anything
44 else of value from a merchant.
45 (2) A municipality may not prohibit the payment of
46 passenger fares for a taxicab, limousine, jitney, or other
47 passenger vehicle for hire by cash, check, or similar method of
48 payment.
49 Section 4. This act shall take effect July 1, 2012.

56 An act relating to passenger vehicles for hire;
57 amending s. 125.01, F.S.; conforming provisions to
58 changes made by the act; creating ss. 125.01035 and
59 166.0433, F.S.; defining the term “payment card” for
60 purposes of the act; prohibiting counties and
61 municipalities from imposing certain restrictions on
62 the accepted methods of payment of passenger fares for
63 certain passenger vehicles for hire; prohibiting
64 counties and municipalities from requiring the payment
65 of passenger fares for such passenger vehicles for
66 hire through use of a payment card; providing an
67 effective date.
