    1                        A bill to be entitled                      
    2         An act relating to the opening and closing of public
    3         schools; amending s. 1001.42, F.S.; authorizing a
    4         district school board to set an opening date for
    5         schools in the district to accommodate the completion
    6         of student classwork and assessments during the fall
    7         term; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (f) of subsection (4) of section
   12  1001.42, Florida Statutes, is amended to read:
   13         1001.42 Powers and duties of district school board.—The
   14  district school board, acting as a board, shall exercise all
   15  powers and perform all duties listed below:
   16         (4) ESTABLISHMENT, ORGANIZATION, AND OPERATION OF SCHOOLS.
   17  Adopt and provide for the execution of plans for the
   18  establishment, organization, and operation of the schools of the
   19  district, including, but not limited to, the following:
   20         (f) Opening and closing of schools; fixing uniform date.
   21  Adopt policies for the opening and closing of schools and fix
   22  uniform dates; however, beginning with the 2007-2008 school
   23  year, the opening date for schools in the district may not be
   24  earlier than 14 days before Labor Day each year. Notwithstanding
   25  this paragraph, a district school board may advance the opening
   26  date for schools in the district by the number of days necessary
   27  to enable students to complete all classwork and assessments for
   28  fall-term courses 5 days before Christmas Day.
   29         Section 2. This act shall take effect July 1, 2012.
