    1                        A bill to be entitled                      
    2         An act relating to juvenile justice education
    3         programs; amending s. 1003.52, F.S.; requiring that
    4         the Department of Education submit to the Legislature
    5         an annual report that includes student learning gains
    6         and student progression in juvenile justice education
    7         programs and details the methodology used by the
    8         department to ensure that student performance data is
    9         complete and reliable; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Paragraph (b) of subsection (3) of section
   14  1003.52, Florida Statutes, is amended to read:
   15         1003.52 Educational services in Department of Juvenile
   16  Justice programs.—
   17         (3) The district school board of the county in which the
   18  residential or nonresidential care facility or juvenile
   19  assessment facility is located shall provide appropriate
   20  educational assessments and an appropriate program of
   21  instruction and special education services.
   22         (b) By October 1, 2004, The Department of Education, with
   23  the assistance of the school districts, shall select a common
   24  student assessment instrument and protocol for measuring student
   25  learning gains and student progression while a student is in a
   26  juvenile justice education program. The assessment instrument
   27  and protocol must be implemented in all juvenile justice
   28  education programs in this state by January 1, 2005. The
   29  Department of Education shall submit to the Legislature an
   30  annual status report that includes the results of the assessment
   31  for measuring student learning gains and student progression and
   32  details the methodology used by the department to ensure that
   33  student performance data is complete and reliable.
   34         Section 2. This act shall take effect July 1, 2012.
