Florida Senate - 2012 SB 1536 By Senator Siplin 19-00018-12 20121536__ 1 A bill to be entitled 2 An act relating to access to criminal history 3 information of minors; amending s. 943.053, F.S.; 4 prohibiting the Department of Law Enforcement from 5 providing, for a fee, the criminal history information 6 of a minor to persons in the private sector or 7 noncriminal justice agencies unless the minor has been 8 convicted of at least one felony or three or more 9 delinquent acts punishable as misdemeanors; providing 10 an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Paragraph (a) of subsection (3) of section 15 943.053, Florida Statutes, is amended to read: 16 943.053 Dissemination of criminal justice information; 17 fees.— 18 (3)(a) Criminal history information, including information 19 relating to minors, compiled by the Criminal Justice Information 20 Program from intrastate sources shall be available on a priority 21 basis to criminal justice agencies for criminal justice purposes 22 free of charge. After providing the program with all known 23 identifying information, persons in the private sector and 24 noncriminal justice agencies may be provided criminal history 25 information upon tender of fees as established in this 26 subsection and in the manner prescribed by rule of the 27 Department of Law Enforcement. Any access to criminal history 28 information by the private sector or noncriminal justice 29 agencies as provided in this subsection shall be assessed 30 without regard to the quantity or category of criminal history 31 record information requested. However, the department may not 32 provide the criminal history information of a minor to any 33 person in the private sector or a noncriminal justice agency 34 unless the minor has been convicted of at least one delinquent 35 act punishable as a felony or three or more delinquent acts 36 punishable as misdemeanors. 37 Section 2. This act shall take effect July 1, 2012.
