1 A bill to be entitled
2 An act relating to education; amending s. 1012.467,
3 F.S.; requiring the Department of Education to create
4 a uniform, statewide identification badge to be worn
5 by noninstructional contractors signifying that a
6 contractor has met specified requirements; requiring
7 school districts to issue the identification badge to
8 a qualified contractor; providing that the
9 identification badge shall be recognized by all school
10 districts; providing that the identification badge is
11 valid for 5 years; establishing conditions for return
12 of an identification badge; requiring the department
13 to determine a uniform cost that a school district may
14 charge a contractor for receipt of the identification
15 badge, which shall be borne by the contractor;
16 providing an exception for certain contractors;
17 providing an effective date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Subsection (8) is added to section 1012.467,
22 Florida Statutes, to read:
23 1012.467 Noninstructional contractors who are permitted
24 access to school grounds when students are present; background
25 screening requirements.—
26 (8)(a) The Department of Education shall create a uniform,
27 statewide identification badge to be worn by noninstructional
28 contractors signifying that a contractor has met the
29 requirements of this section. The school district shall issue an
30 identification badge to the contractor, which must bear a
31 photograph of the contractor. An identification badge shall be
32 issued if the contractor:
33 1. Is a resident and citizen of the United States or a
34 permanent resident alien of the United States as determined by
35 the United States Bureau of Citizenship and Immigration
36 Services;
37 2. Is 18 years of age or older; and
38 3. Meets the background screening requirements under this
39 section.
40 (b) The uniform, statewide identification badge shall be
41 recognized by all school districts and must be visible at all
42 times a noninstructional contractor is on school grounds.
43 (c) The identification badge shall be valid for a period of
44 5 years. If a noninstructional contractor provides notification
45 pursuant to subsection (6), the contractor shall, within 48
46 hours, return the identification badge to the school district
47 that issued the badge.
48 (d) The Department of Education shall determine a uniform
49 cost that a school district may charge a noninstructional
50 contractor for receipt of the identification badge, which shall
51 be borne by the recipient of the badge.
52 (e) This subsection does not apply to noninstructional
53 contractors who are exempt from background screening
54 requirements pursuant to s. 1012.468.
55 Section 2. This act shall take effect upon becoming a law.
