Florida Senate - 2012 SB 1708 By Senator Montford 6-01257A-12 20121708__ 1 A bill to be entitled 2 An act relating to pecans; prohibiting the removal of 3 certain pecans from public rights-of-way or from trees 4 grown on private property; providing a penalty; 5 providing an effective date. 6 7 Be It Enacted by the Legislature of the State of Florida: 8 9 Section 1. Pecans on public rights-of-way; ownership; 10 prohibitions; penalty.— 11 (1) Pecans that fall onto public rights-of-way from trees 12 grown on private property which extend over public roads, 13 streets, or highway rights-of-way are the property of the owner 14 of the pecan trees. 15 (2) It is a misdemeanor of the second degree to remove 16 pecans from: 17 (a) A public right-of-way without the permission of the 18 owner of the pecan tree. 19 (b) A pecan tree grown on private property, or cause pecans 20 to fall from such tree, without the permission of the owner of 21 the pecan tree. 22 (3) A person who violates this section commits a 23 misdemeanor of the second degree, punishable as provided in s. 24 775.082 or s. 775.083, Florida Statutes. 25 Section 2. This act shall take effect July 1, 2012.
