    2         An act relating to voting system audits; amending s.
    3         101.591, F.S.; removing the requirement that the
    4         manual audit of voting systems be conducted using
    5         randomly selected precincts; authorizing the use of
    6         voting units in the audit process; providing an
    7         effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsections (1) and (2) of section 101.591,
   12  Florida Statutes, are amended to read:
   13         101.591 Voting system audit.—
   14         (1) Immediately following the certification of each
   15  election, the county canvassing board or the local board
   16  responsible for certifying the election shall conduct a manual
   17  audit of the voting systems used in randomly selected precincts.
   18         (2) The audit shall consist of a public manual tally of the
   19  votes cast in one randomly selected race that appears on the
   20  ballot. The tally sheet shall include election-day, absentee,
   21  early voting, provisional, and overseas ballots, in at least 1
   22  percent but no more than 2 percent of the precincts chosen or
   23  voting units used, at random by the county canvassing board or
   24  the local board responsible for certifying the election. If 1
   25  percent of the precincts or voting units is less than one entire
   26  precinct or voting unit, the audit shall be conducted using at
   27  least one precinct or voting unit chosen at random by the county
   28  canvassing board or the local board responsible for certifying
   29  the election. Such precincts or voting units shall be selected
   30  at a publicly noticed canvassing board meeting.
   31         Section 2. This act shall take effect July 1, 2012.
