Senator Thrasher moved the following:
1 Senate Amendment (with title amendment)

3 Between lines 426 and 427
4 insert:
5 Section 10. For purposes of clarification of Legislative
6 intent, section 4 of chapter 2009-244, Laws of Florida, is
7 amended to read:
8 Section 4. (1) This award, appropriated up to a grand total
9 of $9.5 million, is intended to provide the sole compensation
10 for all present and future claims arising out of the factual
11 situation described in this act which resulted in the injury to
12 Jorge and Debbie Garcia-Bengochea and their adopted sons, Brian,
13 Matthew, and James Garcia-Bengochea.
14 (2) The total amount paid for attorney attorney’s fees and
15 lobbying fees are to be paid exclusively to the attorneys and
16 lobbyists currently retained by the claimants and registered
17 pursuant to s. 11.045, Florida Statutes, and no other attorneys
18 and lobbyists. The total amount paid for attorney’s fees,
19 lobbying fees, costs, and other similar expenses relating to
20 this claim may not exceed 25 percent of each annual payment
21 awarded pursuant to this act. Further, no more than 25 percent
22 of each annual payment may be used to pay attorney’s fees,
23 lobbying fees, costs, and other similar expenses relating to
24 this claim.
25 Section 11. The provisions of section 10 of this act are
26 remedial.

30 Delete line 47
31 and insert:
32 on identifying and reporting child abuse and neglect;
33 amending section 4 of chapter 2009-244, Laws of
34 Florida, relating to the relief of Jorge and Debbie
35 Garcia- Bengochea and their adoptive children, Brian,
36 Matthew, and James, by the Department of Children and
37 Family Services; clarifying legislative intent
38 regarding the payment of fees to attorneys and
39 lobbyists; providing that the changes are remedial;
