The Committee on Transportation (Benacquisto) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete lines 2825 - 2851
4 and insert:
5 Section 58. Subsections (2) and (4) of section 339.63,
6 Florida Statutes, are amended, and subsections (5) and (6) are
7 added to that section, to read:
8 339.63 System facilities designated; additions and
9 deletions.—
10 (2) The Strategic Intermodal System and the Emerging
11 Strategic Intermodal System include the following five four
12 different types of facilities which that each form one component
13 of an interconnected transportation system which types include:
14 (a) Existing or planned hubs that are ports and terminals
15 including airports, seaports, spaceports, passenger terminals,
16 and rail terminals that serving to move goods or people between
17 Florida regions of the state or between this state Florida and
18 other markets in the United States and the rest of the world.
19 (b) Existing or planned corridors that are highways, rail
20 lines, waterways, and other exclusive-use facilities connecting
21 major markets within the state Florida or between this state
22 Florida and other states or nations.
23 (c) Existing or planned intermodal connectors that are
24 highways, rail lines, waterways or local public transit systems
25 that serve serving as connectors between the components listed
26 in paragraphs (a) and (b).
27 (d) Existing or planned military access facilities that are
28 highways or rail lines linking Strategic Intermodal System
29 corridors to the state’s strategic military installations.
30 (e)(d) Existing or planned facilities that significantly
31 improve the state’s competitive position to compete for the
32 movement of additional goods into and through this state.
33 (4) Except as provided in subsections (5) and (6), after
34 the initial designation of the Strategic Intermodal System under
35 subsection (1), the department shall, in coordination with the
36 metropolitan planning organizations, local governments, regional
37 planning councils, transportation providers, and affected public
38 agencies, add facilities to or delete facilities from the
39 Strategic Intermodal System described in paragraph (2)(a) based
40 upon criteria adopted by the department.
41 (5) However, An airport that is designated as a reliever
42 airport to a Strategic Intermodal System airport which has at
43 least 75,000 itinerant operations per year, has a runway length
44 of at least 5,500 linear feet, is capable of handling aircraft
45 weighing at least 60,000 pounds with a dual wheel configuration
46 which is served by at least one precision instrument approach,
47 and serves a cluster of aviation-dependent industries, shall be
48 designated as part of the Strategic Intermodal System by the
49 Secretary of Transportation upon the request of a reliever
50 airport meeting this criteria.
51 (6)(a) Upon the request of a facility that is described in
52 subsection (2), that meets the definition of an intermodal
53 logistics center as defined in s. 311.101(1), and that has been
54 designated in the local comprehensive plan as an intermodal
55 logistics center or an equivalent planning term, the Secretary
56 of Transportation shall designate such planned facility as part
57 of the Strategic Intermodal System.
58 (b) If a facility is designated as part of the Strategic
59 Intermodal System pursuant to paragraph (a) and is within the
60 jurisdiction of a local government that maintains a
61 transportation concurrency system, such facility shall receive a
62 waiver of transportation concurrency requirements applicable to
63 Strategic Intermodal System facilities in order to accommodate
64 any development at the facility which occurs pursuant to a
65 building permit issued on or before December 31, 2017, but only
66 if such facility is located:
67 1. Within an area designated as a rural area of critical
68 economic concern pursuant to s. 288.0656(7);
69 2. Within a rural enterprise zone as defined in s.
70 290.004(5); or
71 3. Within 10 miles of the boundary of a rural area of
72 critical economic concern or a rural enterprise zone.

79 requiring that the Secretary of Transportation
80 designate certain planned facilities as part of the
81 Strategic Intermodal System; providing for such
82 facilities to receive a waiver of the transportation
83 concurrency requirements under certain circumstances;
