The Committee on Budget (Margolis) recommended the following:
1 Senate Amendment (with title amendment)

3 Between lines 4673 and 4674
4 insert:
5 Section 101. (1) Notwithstanding any other provision of law
6 to the contrary, communications equipment or a cellular
7 communications tower that is intended for railroad use or
8 commercial use, or both, and that is located or will be
9 constructed within a railroad right-of-way corridor is exempt
10 from the Florida Building Code and any county or municipal code
11 or fee, but is subject to review by the rail office of the
12 Department of Transportation for compliance with all applicable
13 railroad regulations.
14 (2) Any private communications equipment that is not
15 intended for railroad use and that collocates upon an existing
16 communications equipment or a cellular communications tower
17 intended for railroad use within a railroad right-of-way must
18 comply with the Florida Building Code.

21 And the title is amended as follows:
22 Between lines 462 and 463
23 insert:
24 exempting communications equipment intended for
25 railroad use in a designated railroad right-of-way
26 from the Florida Building Code and any county or
27 municipal code or fee; providing that such equipment
28 is subject to review by the rail office of the
29 Department of Transportation for compliance with
30 applicable railroad regulations; authorizing private
31 communications equipment not intended for railroad use
32 to collocate upon an existing tower intended for
33 railroad use within a designated railroad right-of
34 way; requiring that collocated equipment be in
35 compliance with the Florida Building Code;
