The Conference Committee on SB 1958 recommended the following:
1 Senate Conference Committee Amendment (with title
2 amendment)

4 Delete everything after the enacting clause
5 and insert:
6 Section 1. Subsections (1) and (3) of section 945.602,
7 Florida Statutes, are amended to read:
8 945.602 State of Florida Correctional Medical Authority;
9 creation; members.—
10 (1) There is created the State of Florida Correctional
11 Medical Authority, which for administrative purposes shall be
12 assigned to the Executive Office of the Governor Department of
13 Health. The governing board of the authority shall be composed
14 of seven nine persons appointed by the Governor subject to
15 confirmation by the Senate. One member must be a member of the
16 Florida Hospital Association; one member must be a member of the
17 Florida League of Hospitals; one member must be a member of the
18 Association of Community Hospitals and Health Systems of
19 Florida; and one member must be a member of the Florida Medical
20 Association. The authority shall contract with the Executive
21 Office of the Governor Department of Health for the provision of
22 administrative support services, including purchasing,
23 personnel, general services, and budgetary matters. The
24 authority is shall not be subject to control, supervision, or
25 direction by the Executive Office of the Governor Department of
26 Health or the Department of Corrections. The authority shall
27 annually elect one member to serve as chair. Members shall be
28 appointed for terms of 4 years each. Each member may is
29 authorized to continue to serve upon the expiration of his or
30 her term until a successor is duly appointed as provided in this
31 section. Before entering upon his or her duties, each member of
32 the authority shall take and subscribe to the oath or
33 affirmation required by the State Constitution.
34 (3) Effective for new appointments after July 1, 1996, At
35 least one member of the authority must be a physician licensed
36 under chapter 458, and one member of the authority may be a
37 physician licensed under chapter 458 or chapter 459. At least
38 two other members of the authority must have had at least 5
39 years’ experience in health care administration.
40 Section 2. All powers, duties, functions, records, offices,
41 personnel, associated administrative support positions,
42 property, pending issues, existing contracts, administrative
43 authority, and administrative rules relating to the State of
44 Florida Correctional Medical Authority in the Department of
45 Health are transferred to the Executive Office of the Governor.
46 Section 3. This act shall take effect July 1, 2012.

53 An act relating to the Department of Health; amending
54 s. 945.602, F.S.; assigning, for administrative
55 purposes, the Correctional Medical Authority to the
56 Executive Office of the Governor, rather than the
57 Department of Health; reducing the membership of the
58 authority; conforming provisions to changes made by
59 the act; deleting an obsolete provision; providing for
60 a transfer of the administration of the Correctional
61 Medical Authority from the Department of Health to the
62 Executive Office of the Governor; providing an
63 effective date.
