1 A bill to be entitled
2 An act relating to postsecondary education; amending
3 s. 1004.345, F.S.; deleting provisions creating the
4 University of South Florida Polytechnic; requiring
5 that the Florida Polytechnic University meet certain
6 criteria established by the Board of Governors by a
7 specified date; requiring that the Board of Trustees
8 of the Florida Polytechnic University notify the Board
9 of Governors when such criteria are met; requiring
10 that students enrolled at the University of South
11 Florida Polytechnic be afforded the opportunity to
12 complete their degrees at the University of South
13 Florida; transferring all real and personal property,
14 licenses, contracts, and associated funds from the
15 University of South Florida Polytechnic to the Florida
16 Polytechnic University; transferring all programs,
17 functions, offices, records, and faculty and staff
18 positions from the University of South Florida
19 Polytechnic to the University of South Florida;
20 authorizing the Board of Trustees of the Florida
21 Polytechnic University to certify a direct-support
22 organization to serve the Florida Polytechnic
23 University; requiring that the Board of Trustees of
24 the University of South Florida and the University of
25 South Florida Foundation transfer to the new
26 foundation assets that were intended for the
27 University of South Florida Polytechnic; providing
28 that memorandums of understanding between the
29 University of South Florida and the University of
30 South Florida Polytechnic are invalid upon the act
31 becoming law; requiring that the University of South
32 Florida transfer the lease of certain federal
33 communications licenses and the proceeds from such
34 lease to the Florida Polytechnic University; requiring
35 the transfer of space at the Lakeland joint-use
36 facility to Polk State College when the Florida
37 Polytechnic University no longer needs the space;
38 requiring that the University of Florida be available
39 in an advisory or consulting capacity to assist the
40 Florida Polytechnic University; amending s. 1001.21,
41 F.S.; revising the definition of “state university” to
42 include the Florida Polytechnic University; amending
43 s. 1004.346, F.S.; revising provisions relating to the
44 Florida Industrial and Phosphate Research Institute,
45 to conform to changes made by the act; amending s.
46 1004.387, F.S.; providing for a doctor of pharmacy
47 degree program at the University of South Florida;
48 deleting provisions that authorize the development and
49 implementation of the program on the campus of the
50 University of South Florida Polytechnic; amending s.
51 1013.74, F.S.; authorizing a university board of
52 trustees to expend certain reserve or carry-forward
53 balances from prior years for capital outlay projects
54 for a new campus for specified fiscal years; providing
55 an effective date.

57 Be It Enacted by the Legislature of the State of Florida:
58
59 Section 1. Section 1004.345, Florida Statutes, is amended
60 to read:
61 (Substantial rewording of section. See
62 s. 1004.345, F.S., for present text.)
63 1004.345 The Florida Polytechnic University.—
64 (1) By December 31, 2016, the Florida Polytechnic
65 University shall meet the following criteria as established by
66 the Board of Governors:
67 (a) Achieve accreditation from the Commission on Colleges
68 of the Southern Association of Colleges and Schools;
69 (b) Initiate the development of the new programs in the
70 fields of science, technology, engineering, and mathematics;
71 (c) Seek discipline-specific accreditation for programs;
72 (d) Attain a minimum FTE of 1,244, with a minimum 50
73 percent of that FTE in the fields of science, technology,
74 engineering, and mathematics and 20 percent in programs related
75 to those fields;
76 (e) Complete facilities and infrastructure, including the
77 Science and Technology Building, Phase I of the Wellness Center,
78 the 70-bed modular resident hall, and the 120-bed residence
79 hall; and
80 (f) Have the ability to provide, either directly or where
81 feasible through a shared services model, administration of
82 financial aid, admissions, student support, information
83 technology, and finance and accounting with an internal audit
84 function.
85 (2) Once the criteria in subsection (1) have been met, the
86 Board of Trustees of the Florida Polytechnic University shall
87 notify the Board of Governors, and the Board of Governors shall
88 conduct a final review to confirm that the criteria have been
89 met.
90 (3) Students enrolled at the University of South Florida
91 Polytechnic shall be afforded the opportunity to complete their
92 degrees at the University of South Florida, subject to
93 university criteria.
94 Section 2. (1) All real and personal property, licenses and
95 associated revenues, existing contracts, and unexpended
96 balances, appropriations, allocations, and other funds of the
97 University of South Florida Polytechnic shall be transferred to
98 the Florida Polytechnic University.
99 (2) All programs, functions, offices, records, faculty
100 positions, and staff positions of the University of South
101 Florida Polytechnic shall be transferred to the University of
102 South Florida.
103 Section 3. In accordance with s. 1004.28, Florida Statutes,
104 and the regulations of the Board of Governors, the Board of
105 Trustees of the Florida Polytechnic University may certify a
106 direct-support organization to serve the Florida Polytechnic
107 University. The Board of Trustees of the University of South
108 Florida, in conjunction with the University of South Florida
109 Foundation, shall develop and implement a plan to transfer to
110 the new foundation assets derived from donations intended for
111 the enhancement of the University of South Florida Polytechnic.
112 Section 4. All memorandums of understanding between the
113 University of South Florida and the University of South Florida
114 Polytechnic and its successors shall be invalid upon this act
115 becoming a law.
116 Section 5. The University of South Florida shall transfer
117 the lease of federal communications licenses relating to Polk
118 County to the Florida Polytechnic University. All future
119 proceeds and any associated revenues from the lease of the
120 licenses shall accrue to the Florida Polytechnic University.
121 Section 6. The Florida Polytechnic University shall
122 transfer space at the Lakeland joint-use facility to Polk State
123 College as new space becomes available on the new campus of the
124 Florida Polytechnic University. Once the Florida Polytechnic
125 University has no further need for the space at the Lakeland
126 joint-use facility, the Florida Polytechnic University shall
127 complete the transfer of all remaining property and buildings of
128 the joint-use facility to Polk State College.
129 Section 7. The University of Florida, using its expertise
130 in the disciplines of science, technology, engineering, and
131 mathematics, shall be available in an advisory or consulting
132 capacity to assist the president and the Board of Trustees of
133 the Florida Polytechnic University in hiring, accreditation,
134 administration, and other areas.
135 Section 8. Paragraph (l) is added to subsection (6) of
136 section 1000.21, Florida Statutes, to read:
137 1000.21 Systemwide definitions.—As used in the Florida K-20
138 Education Code:
139 (6) “State university,” except as otherwise specifically
140 provided, includes the following institutions and any branch
141 campuses, centers, or other affiliates of the institution:
142 (l) The Florida Polytechnic University.
143 Section 9. Subsection (1), paragraph (b) of subsection (2),
144 and subsection (3) of section 1004.346, Florida Statutes, are
145 amended to read:
146 1004.346 Florida Industrial and Phosphate Research
147 Institute.—
148 (1) INSTITUTE CREATION.—The Florida Industrial and
149 Phosphate Research Institute is established within the Florida
150 Polytechnic University University of South Florida Polytechnic.
151 (2) PHOSPHATE RESEARCH AND ACTIVITIES BOARD.—The Phosphate
152 Research and Activities Board is created to monitor the
153 expenditure of funds appropriated to the university from the
154 Phosphate Research Trust Fund.
155 (b) The board shall consist of five members. The Governor
156 shall appoint two persons representing the phosphate mining or
157 processing industry and one member representing a major
158 environmental conservation group in the state. The Secretary of
159 Environmental Protection or his or her designee and the
160 President Campus Executive Officer of the Florida Polytechnic
161 University University of South Florida Polytechnic shall also
162 serve as board members.
163 (3) INSTITUTE EXECUTIVE DIRECTOR.—An executive director
164 shall be designated by and serve at the pleasure of the
165 President Campus Executive Officer of the Florida Polytechnic
166 University University of South Florida Polytechnic or his or her
167 designee. The executive director shall be responsible for the
168 daily administration of the institute, including the expenditure
169 of funds from all sources. The executive director shall consult
170 with the Phosphate Research and Activities Board on the projects
171 that the institute expects to undertake using moneys
172 appropriated from the Phosphate Research Trust Fund.
173 Section 10. Section 1004.387, Florida Statutes, is amended
174 to read:
175 1004.387 Doctor of pharmacy degree program at the
176 University of South Florida.—A doctor of pharmacy degree program
177 is authorized at the University of South Florida. The program
178 shall be physically located on the new campus of the University
179 of South Florida Polytechnic. The university is authorized to
180 develop and implement the program within existing facilities
181 only until the construction of a pharmacy facility on the new
182 campus of the University of South Florida Polytechnic is
183 completed, which shall house the doctor of pharmacy degree
184 program.
185 Section 11. Subsection (6) is added to section 1013.74,
186 Florida Statutes, to read:
187 1013.74 University authorization for fixed capital outlay
188 projects.—
189 (6) For the 2011-2012 through 2022-2023 fiscal years, a
190 university board of trustees may expend reserve or carry-forward
191 balances from prior year operational and programmatic
192 appropriations for legislatively approved fixed capital outlay
193 projects authorized for the establishment of a new campus.
194 Section 12. This act shall take effect upon becoming a law.
