1 A bill to be entitled
2 An act relating to postsecondary education; amending
3 s. 1004.345, F.S.; deleting provisions creating the
4 University of South Florida Polytechnic; requiring
5 that the Florida Polytechnic University meet certain
6 criteria established by the Board of Governors by a
7 specified date; requiring that the Board of Trustees
8 of the Florida Polytechnic University notify the Board
9 of Governors when such criteria are met; requiring
10 that students enrolled at the University of South
11 Florida Polytechnic be afforded the opportunity to
12 complete their degrees at the University of South
13 Florida; transferring all real and personal property,
14 licenses, contracts, and associated funds from the
15 University of South Florida Polytechnic to the Florida
16 Polytechnic University; transferring all Florida
17 Industrial and Phosphate Research Institute programs,
18 functions, offices, records, faculty positions, and
19 staff positions from the University of South Florida
20 Polytechnic to the Florida Polytechnic University;
21 transferring all programs, functions, offices,
22 records, and faculty and staff positions from the
23 University of South Florida Polytechnic to the
24 University of South Florida when certain transfers are
25 complete; authorizing the Board of Trustees of the
26 Florida Polytechnic University to certify a direct
27 support organization to serve the Florida Polytechnic
28 University; requiring that the Board of Trustees of
29 the University of South Florida and the University of
30 South Florida Foundation transfer to the new
31 foundation assets that were intended for the
32 University of South Florida Polytechnic; providing
33 that memorandums of understanding between the
34 University of South Florida and the University of
35 South Florida Polytechnic are invalid upon the act
36 becoming law; requiring that the University of South
37 Florida transfer the lease of certain federal
38 communications licenses and the proceeds from such
39 lease to the Florida Polytechnic University; requiring
40 the transfer of space at the Lakeland joint-use
41 facility to Polk State College when the Florida
42 Polytechnic University no longer needs the space;
43 requiring that the University of Florida be available
44 in an advisory or consulting capacity to assist the
45 Florida Polytechnic University; amending s. 1001.21,
46 F.S.; revising the definition of “state university” to
47 include the Florida Polytechnic University; amending
48 s. 1004.346, F.S.; revising provisions relating to the
49 Florida Industrial and Phosphate Research Institute,
50 to conform to changes made by the act; amending s.
51 1004.387, F.S.; providing for a doctor of pharmacy
52 degree program at the University of South Florida;
53 deleting provisions that authorize the development and
54 implementation of the program on the campus of the
55 University of South Florida Polytechnic; amending s.
56 1013.74, F.S.; authorizing a university board of
57 trustees to expend certain reserve or carry-forward
58 balances from prior years for capital outlay projects
59 for a new campus for specified fiscal years; providing
60 an effective date.

62 Be It Enacted by the Legislature of the State of Florida:
63
64 Section 1. Section 1004.345, Florida Statutes, is amended
65 to read:
66 (Substantial rewording of section. See
67 s. 1004.345, F.S., for present text.)
68 1004.345 The Florida Polytechnic University.—
69 (1) By December 31, 2016, the Florida Polytechnic
70 University shall meet the following criteria as established by
71 the Board of Governors:
72 (a) Achieve accreditation from the Commission on Colleges
73 of the Southern Association of Colleges and Schools;
74 (b) Initiate the development of the new programs in the
75 fields of science, technology, engineering, and mathematics;
76 (c) Seek discipline-specific accreditation for programs;
77 (d) Attain a minimum FTE of 1,244, with a minimum 50
78 percent of that FTE in the fields of science, technology,
79 engineering, and mathematics and 20 percent in programs related
80 to those fields;
81 (e) Complete facilities and infrastructure, including the
82 Science and Technology Building, Phase I of the Wellness Center,
83 the 70-bed modular resident hall, and the 120-bed residence
84 hall; and
85 (f) Have the ability to provide, either directly or where
86 feasible through a shared services model, administration of
87 financial aid, admissions, student support, information
88 technology, and finance and accounting with an internal audit
89 function.
90 (2) Once the criteria in subsection (1) have been met, the
91 Board of Trustees of the Florida Polytechnic University shall
92 notify the Board of Governors, and the Board of Governors shall
93 conduct a final review to confirm that the criteria have been
94 met.
95 (3) Students enrolled at the University of South Florida
96 Polytechnic shall be afforded the opportunity to complete their
97 degrees at the University of South Florida, subject to
98 university criteria.
99 Section 2. (1) All real and personal property, licenses and
100 associated revenues, existing contracts, and unexpended
101 balances, appropriations, allocations, and other funds of the
102 University of South Florida Polytechnic shall be transferred to
103 the Florida Polytechnic University.
104 (2) All Florida Industrial and Phosphate Research Institute
105 programs, functions, offices, records, faculty positions, and
106 staff positions of the University of South Florida Polytechnic
107 shall be transferred to the Florida Polytechnic University.
108 (3) After the transfers required in subsections (1) and (2)
109 are complete, all programs, functions, offices, records, faculty
110 positions, and staff positions of the University of South
111 Florida Polytechnic shall be transferred to the University of
112 South Florida.
113 Section 3. In accordance with s. 1004.28, Florida Statutes,
114 and the regulations of the Board of Governors, the Board of
115 Trustees of the Florida Polytechnic University may certify a
116 direct-support organization to serve the Florida Polytechnic
117 University. The Board of Trustees of the University of South
118 Florida, in conjunction with the University of South Florida
119 Foundation, shall develop and implement a plan to transfer to
120 the new foundation assets derived from donations intended for
121 the enhancement of the University of South Florida Polytechnic.
122 Section 4. All memorandums of understanding between the
123 University of South Florida and the University of South Florida
124 Polytechnic and its successors shall be invalid upon this act
125 becoming a law.
126 Section 5. The University of South Florida shall transfer
127 the lease of federal communications licenses relating to Polk
128 County to the Florida Polytechnic University. All future
129 proceeds and any associated revenues from the lease of the
130 licenses shall accrue to the Florida Polytechnic University.
131 Section 6. The Florida Polytechnic University shall
132 transfer space at the Lakeland joint-use facility to Polk State
133 College as new space becomes available on the new campus of the
134 Florida Polytechnic University. Once the Florida Polytechnic
135 University has no further need for the space at the Lakeland
136 joint-use facility, the Florida Polytechnic University shall
137 complete the transfer of all remaining property and buildings of
138 the joint-use facility to Polk State College.
139 Section 7. The University of Florida, using its expertise
140 in the disciplines of science, technology, engineering, and
141 mathematics, shall be available in an advisory or consulting
142 capacity to assist the president and the Board of Trustees of
143 the Florida Polytechnic University in hiring, accreditation,
144 administration, and other areas.
145 Section 8. Paragraph (l) is added to subsection (6) of
146 section 1000.21, Florida Statutes, to read:
147 1000.21 Systemwide definitions.—As used in the Florida K-20
148 Education Code:
149 (6) “State university,” except as otherwise specifically
150 provided, includes the following institutions and any branch
151 campuses, centers, or other affiliates of the institution:
152 (l) The Florida Polytechnic University.
153 Section 9. Subsection (1), paragraph (b) of subsection (2),
154 and subsection (3) of section 1004.346, Florida Statutes, are
155 amended to read:
156 1004.346 Florida Industrial and Phosphate Research
157 Institute.—
158 (1) INSTITUTE CREATION.—The Florida Industrial and
159 Phosphate Research Institute is established within the Florida
160 Polytechnic University University of South Florida Polytechnic.
161 (2) PHOSPHATE RESEARCH AND ACTIVITIES BOARD.—The Phosphate
162 Research and Activities Board is created to monitor the
163 expenditure of funds appropriated to the university from the
164 Phosphate Research Trust Fund.
165 (b) The board shall consist of five members. The Governor
166 shall appoint two persons representing the phosphate mining or
167 processing industry and one member representing a major
168 environmental conservation group in the state. The Secretary of
169 Environmental Protection or his or her designee and the
170 President Campus Executive Officer of the Florida Polytechnic
171 University University of South Florida Polytechnic shall also
172 serve as board members.
173 (3) INSTITUTE EXECUTIVE DIRECTOR.—An executive director
174 shall be designated by and serve at the pleasure of the
175 President Campus Executive Officer of the Florida Polytechnic
176 University University of South Florida Polytechnic or his or her
177 designee. The executive director shall be responsible for the
178 daily administration of the institute, including the expenditure
179 of funds from all sources. The executive director shall consult
180 with the Phosphate Research and Activities Board on the projects
181 that the institute expects to undertake using moneys
182 appropriated from the Phosphate Research Trust Fund.
183 Section 10. Section 1004.387, Florida Statutes, is amended
184 to read:
185 1004.387 Doctor of pharmacy degree program at the
186 University of South Florida.—A doctor of pharmacy degree program
187 is authorized at the University of South Florida. The program
188 shall be physically located on the new campus of the University
189 of South Florida Polytechnic. The university is authorized to
190 develop and implement the program within existing facilities
191 only until the construction of a pharmacy facility on the new
192 campus of the University of South Florida Polytechnic is
193 completed, which shall house the doctor of pharmacy degree
194 program.
195 Section 11. Subsection (6) is added to section 1013.74,
196 Florida Statutes, to read:
197 1013.74 University authorization for fixed capital outlay
198 projects.—
199 (6) For the 2011-2012 through 2022-2023 fiscal years, a
200 university board of trustees may expend reserve or carry-forward
201 balances from prior year operational and programmatic
202 appropriations for legislatively approved fixed capital outlay
203 projects authorized for the establishment of a new campus.
204 Section 12. This act shall take effect upon becoming a law.
