       Senator Bogdanoff moved the following:
       
    1         Senate Substitute for Amendment (274610) (with title
    2  amendment)
    3  
    4         Delete lines 322 - 329
    5  and insert:
    6         (11) The contractor shall pay to the Department of
    7  Management Services all of the reasonable and direct costs,
    8  certified by the Department of Management Services to the
    9  contractor and included in the contract, which are associated
   10  with the pursuit and apprehension of an escapee from the secure
   11  perimeter of a correctional facility or assigned correctional
   12  unit and incurred by any state or local law enforcement agency
   13  while involved in the pursuit or apprehension of such an escapee
   14  during the 10 days after the inmate’s escape. The Department of
   15  Management Services shall adopt procedures by rule for state or
   16  local law enforcement agencies to identify and certify such
   17  costs to the department. After the Department of Management
   18  Services receives payment for such costs from the contractor,
   19  the department shall reimburse state and local law enforcement
   20  agencies for their respective reasonable and direct costs.

   23         And the title is amended as follows:
   24         Delete lines 80 - 81
   25  and insert:
   26         involved in the pursuit and apprehension of an escapee
   27         during a specified period after the inmate’s escape;
   28         requiring that the Department of Management Services
   29         adopt procedures by rule for identifying and
   30         certifying such costs; requiring that the Department
   31         of Management Services reimburse such costs to state
   32         and local law enforcement agencies;
