Florida Senate - 2012 SB 216 By Senator Lynn 7-00238-12 2012216__ 1 A bill to be entitled 2 An act relating to a moratorium on permits for the 3 consumptive use of water for commercial profit; 4 amending s. 373.219, F.S.; prohibiting until July 1, 5 2022, the governing board of a water management 6 district or the Department of Environmental Protection 7 from approving an application for a required permit if 8 the applicant intends to resell the water for a 9 commercial profit; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Section 373.219, Florida Statutes, is amended to 14 read: 15 373.219 Permits required; moratorium on issuing permits.— 16 (1)(a) The governing board or the department may require 17 such permits for consumptive use of water and may impose such 18 reasonable conditions as are necessary to ensureassurethat 19 such use is consistent with the overall objectives of the 20 district or department and is not harmful to the water resources 21 of the area. However, no permit shall be required for domestic 22 consumption of water by individual users. 23 (b) Notwithstanding any other provision of this chapter, 24 the governing board or the department may not approve until July 25 1, 2022, an application for an otherwise required permit for the 26 consumptive use of water if the applicant for the permit 27 proposes to purchase the water with the intent to resell the 28 water to the consuming public for a commercial profit. 29 (2) In the event that any person shall file a complaint 30 with the governing board or the department that any other person 31 is making a diversion, withdrawal, impoundment, or consumptive 32 use of water not expressly exempted under the provisions of this 33 chapter and without a permit to do so, the governing board or 34 the department shall cause an investigation to be made, and if 35 the facts stated in the complaint are verified the governing 36 board or the department shall order the discontinuance of the 37 use. 38 Section 2. This act shall take effect July 1, 2012.
