Floor: 1a/F/2R . 03/08/2012 06:08 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Bennett moved the following: 1 Senate Amendment to Amendment (920062) 2 3 Delete lines 21 - 54 4 and insert: 5 in the English language, in which 25 percent of the content is 6 news and editorial in nature, and whose total minimum 7 circulation of greater than 2,500 is biannually audited and 8 certified in an affidavit by an independent third-party auditor 9 approved by the Community Papers of Florida, the Florida 10 Community Paper Advertising Network, the Florida Press 11 Association, or a similarly sanctioned organization recognized 12 by the newspaper industry or entered or qualified to be admitted 13 and entered as periodicals matter at a post office in the county 14 where published,for sale to the public generally, available to15the public generallyfor the publication of official or other 16 notices and customarily containing information of a public 17 character or of interest or of value to the residents or owners 18 of property in the county where published, or of interest or of 19 value to the general public. 20 Section 2. Section 50.031, Florida Statutes, is amended to 21 read: 22 50.031 Newspapers in which legal notices and process may be 23 published.—No notice or publication required to be published in 24 a newspaper in the nature of or in lieu of process of any kind, 25 nature, character or description provided for under any law of 26 the state, whether heretofore or hereafter enacted, and whether 27 pertaining to constructive service, or the initiating, assuming, 28 reviewing, exercising or enforcing jurisdiction or power, by any 29 court in this state, or any notice of sale of property, real or 30 personal, for taxes, state, county or municipal, or sheriff’s, 31 guardian’s or administrator’s or any sale made pursuant to any 32 judicial order, decree or statute or any other publication or 33 notice pertaining to any affairs of the state, or any county, 34 municipality or other political subdivision thereof, shall be 35 deemed to have been published in accordance with the statutes 36 providing for such publication, unless the same shall have been 37 published for the prescribed period of time required for such 38 publication, in a newspaper which at the time of such 39 publication shall have been in existence for 1 year, in which 25 40 percent of the content is news and editorial in nature, and 41 whose total minimum circulation of greater than 2,500 is 42 biannually audited and certified in an affidavit
