A bill to be entitled
2An act relating to employment practices; prohibiting
3the use of a job applicant's personal credit history
4as a hiring criterion; providing an exception;
5providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:

9     Section 1.  (1)  Except where required by law, it is an
10improper employment practice for an employer to directly or
11indirectly use a job applicant's personal credit history as a
12hiring criterion.
13     (2)  Notwithstanding subsection (1), an employer may
14request a credit history background check as part of the
15application process if such history is shown to be directly
16related to the position sought by the applicant. However, such
17history may not be the determining factor in whether the
18applicant is ultimately hired to the position sought.
19     Section 2.  This act shall take effect July 1, 2012.
