House Joint Resolution
2A joint resolution proposing the creation of Section
328 of Article X of the State Constitution to prohibit
4the naming of public buildings and facilities for a
5person not deceased for a certain period of time
6unless approved by a four-fifths vote of the
7governmental body enacting the designation, except
8that no such building or facility may be named for a
9public officer while that person is in public office.

11Be It Resolved by the Legislature of the State of Florida:
12
13     That the following creation of Section 28 of Article X of
14the State Constitution is agreed to and shall be submitted to
15the electors of this state for approval or rejection at the next
16general election or at an earlier special election specifically
17authorized by law for that purpose:

MISCELLANEOUS
20     SECTION 28.  Naming of public buildings and other
21facilities.-
22     (a)  Except as otherwise provided in this section, a
23publicly owned building, road, bridge, park, recreational
24complex, or other similar facility may not be named for any
25person who has not been deceased for at least five years.
26     (b)  A publicly owned building, road, bridge, park,
27recreational complex, or other similar facility may be named for
28a living person or a person who has been deceased for less than
29five years if the name designation is approved by a four-fifths
30vote of the governmental body enacting the designation; however,
31such a facility may not be named for a public officer while that
32person is in public office.
33     BE IT FURTHER RESOLVED that the following statement be
34placed on the ballot:

38amendment to the State Constitution that prohibits naming a
39publicly owned building, road, bridge, park, recreational
40complex, or other similar facility after a person who has not
41been deceased for at least 5 years unless approved by a four-
42fifths vote of the governing body naming the building or
43facility, except that no such building or facility may be named
44after a public officer while that person is in office.
