       The Committee on Commerce and Tourism (Montford) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 66 - 70
    4  and insert:
    5         8. Any apartment building inspected by the United States
    6  Department of Housing and Urban Development or other entity
    7  acting on the department’s behalf which is designated primarily
    8  as housing for persons at least 62 years of age. The division
    9  may require the operator of the establishment to attest in
   10  writing that the apartment meets the criteria in this
   11  subparagraph. The division may adopt rules to implement this
   12  exclusion.
   13         Section 2. This act shall take effect October 1, 2012.

   16         And the title is amended as follows:
   17         Delete line 6
   18  and insert:
   19         housing for persons at least 62 years of age;
   20         providing that the Department of Business and
   21         Professional Regulation may require written
   22         attestation from the operator of the establishment
   23         that the apartment meets specified criteria;
   24         authorizing the Division of Hotels and Restaurants to
   25         adopt rules;
