A bill to be entitled
2An act relating to health care; amending ss. 458.309
3and 459.005, F.S.; requiring that any physician or
4osteopathic physician who performs certain medical
5procedures in an office setting register the office
6with the Department of Health unless that office is
7licensed as a facility under ch. 395, F.S., relating
8to hospital licensing and regulation; providing an
9effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Subsection (3) of section 458.309, Florida
14Statutes, is amended to read:
15     458.309  Rulemaking authority.-
16     (3)  Any physician All physicians who performs liposuction
17procedures in which more than 1,000 cubic centimeters of
18supernatant fat is removed, perform level 2 procedures lasting
19more than 5 minutes, and all level 3 surgical procedures in an
20office setting must register the office with the department
21unless that office is licensed as a facility under pursuant to
22chapter 395. The department shall inspect the physician's office
23annually unless the office is accredited by a nationally
24recognized accrediting agency or an accrediting organization
25subsequently approved by the Board of Medicine. The actual costs
26for registration and inspection or accreditation shall be paid
27by the person seeking to register and operate the office setting
28in which office surgery is performed.
29     Section 2.  Subsection (2) of section 459.005, Florida
30Statutes, is amended to read:
31     459.005  Rulemaking authority.-

45     Section 3.  This act shall take effect upon becoming a law.
