Florida Senate - 2012 SB 544 By Senator Sobel 31-00328-12 2012544__ 1 A bill to be entitled 2 An act relating to health care; amending ss. 458.309 3 and 459.005, F.S.; requiring that any physician or 4 osteopathic physician who performs certain medical 5 procedures in an office setting to register the office 6 with the Department of Health unless that office is 7 licensed as a facility under ch. 395, F.S., relating 8 to hospital licensing and regulation; providing an 9 effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Subsection (3) of section 458.309, Florida 14 Statutes, is amended to read: 15 458.309 Rulemaking authority.— 16 (3) Any physicianAll physicianswho performs liposuction 17 procedures in which more than 1,000 cubic centimeters of 18 supernatant fat is removed,performlevel 2 procedures lasting 19 more than 5 minutes, and all level 3 surgical procedures in an 20 office setting must register the office with the department 21 unless that office is licensed as a facility underpursuant to22 chapter 395. The department shall inspect the physician’s office 23 annually unless the office is accredited by a nationally 24 recognized accrediting agency or an accrediting organization 25 subsequently approved by the Board of Medicine. The actual costs 26 for registration and inspection or accreditation shall be paid 27 by the person seeking to register and operate the office setting 28 in which office surgery is performed. 29 Section 2. This act shall take effect upon becoming a law.
