2 | A memorial to the Congress of the United States, |
3 | urging Congress to discontinue its practice of |
4 | imposing federal mandates and legislation upon the |
5 | states which exceed the scope of its constitutionally |
6 | delegated powers under the Tenth Amendment to the |
7 | Constitution of the United States and to repeal |
8 | existing compulsory federal legislation that directs |
9 | the states to comply or requires the states to pass |
10 | specific legislation in order not to lose federal |
11 | funding. |

13 | WHEREAS, the people of the State of Florida assert their |
14 | residual and inviolable sovereignty under the Tenth Amendment to |
15 | the Constitution of the United States over all powers not |
16 | otherwise enumerated and granted to the Federal Government by |
17 | that Constitution, and |
18 | WHEREAS, the people of the State of Florida also refuse to |
19 | comply with mandates issued by any branch of the Federal |
20 | Government which are beyond the scope of such constitutionally |
21 | delegated powers and demand that the Federal Government cease |
22 | and desist from issuing mandates that are beyond the scope of |
23 | such powers, and |
24 | WHEREAS, the people of the State of Florida further refuse |
25 | to recognize or comply with any compulsory federal legislation |
26 | that directs the state to comply or requires the state to pass |
27 | specific legislation in order not to lose federal funding, and |
28 | WHEREAS, the sovereignty of the State of Florida is |
29 | threatened by federal mandates and legislation that exceed the |
30 | scope of power delegated to the Federal Government under the |
31 | Tenth Amendment to the Constitution of the United States, and |
32 | WHEREAS, the imposition of excessive federal enactments |
33 | diminishes the rights and abilities of the people of the State |
34 | of Florida to govern themselves as a free and independent state, |
35 | NOW, THEREFORE, |

37 | Be It Resolved by the Legislature of the State of Florida: |

39 | That the Congress of the United States is urged to |
40 | discontinue its current practice of imposing federal mandates |
41 | and legislation upon the states which exceed the scope of its |
42 | constitutionally delegated powers under the Tenth Amendment to |
43 | Constitution of the United States. |
44 | BE IT FURTHER RESOLVED that the Congress is also urged to |
45 | repeal all existing compulsory federal legislation that directs |
46 | the states to comply or requires the states to pass specific |
47 | legislation in order not to lose federal funding. |
48 | BE IT FURTHER RESOLVED that copies of this memorial be |
49 | dispatched to the President of the United States, to the |
50 | President of the United States Senate, to the Speaker of the |
51 | United States House of Representatives, and to each member of |
52 | the Florida delegation to the United States Congress. |
