       Senator Bennett moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 322 and 323
    4  insert:
    5         Section 3. Subsection (26) of section 334.044, Florida
    6  Statutes, is amended to read:
    7         334.044 Department; powers and duties.—The department shall
    8  have the following general powers and duties:
    9         (26) To provide for the enhancement of environmental
   10  benefits, including air and water quality; to prevent roadside
   11  erosion; to conserve the natural roadside growth and scenery;
   12  and to provide for the implementation and maintenance of
   13  roadside conservation, enhancement, and stabilization programs.
   14  No less than 1.5 percent of the amount contracted for
   15  construction projects that add capacity or provide significant
   16  enhancements to the existing system shall be allocated by the
   17  department for the purchase of plant materials. Department
   18  districts may not expend funds for landscaping in connection
   19  with any project that is limited to resurfacing existing lanes
   20  unless the expenditure has been approved by the department’s
   21  secretary or the secretary’s designee., with, To the greatest
   22  extent practical, a minimum of 50 percent of these funds shall
   23  be allocated for large plant materials and the remaining funds
   24  for other plant materials. All such plant materials shall be
   25  purchased from Florida commercial nursery stock in this state on
   26  a uniform competitive bid basis. The department will develop
   27  grades and standards for landscaping materials purchased through
   28  this process. To accomplish these activities, the department may
   29  contract with nonprofit organizations having the primary purpose
   30  of developing youth employment opportunities.

   35  and insert:
   36         specified terms and conditions; amending s. 334.044,
   37         F.S.; clarifying that amounts allocated by the
   38         department for the purchase of plant materials are for
   39         certain types of construction projects; limiting the
   40         expenditure of funds for landscaping in connection
   41         with certain projects unless the department secretary
   42         or his or her designee approves the expenditure;
