1 A bill to be entitled
2 An act relating to postsecondary education; amending
3 s. 1004.345, F.S.; deleting provisions creating the
4 University of South Florida Polytechnic; requiring
5 that the Florida Polytechnic University meet certain
6 criteria established by the Board of Governors by a
7 specified date; requiring that the Board of Trustees
8 of the Florida Polytechnic University notify the Board
9 of Governors when such criteria are met; requiring
10 that students enrolled at the University of South
11 Florida Polytechnic be afforded the opportunity to
12 complete their degrees at the University of South
13 Florida; transferring all real and personal property,
14 licenses, contracts, and associated funds from the
15 University of South Florida Polytechnic to the Florida
16 Polytechnic University; transferring all programs,
17 functions, offices, records, and faculty and staff
18 positions from the University of South Florida
19 Polytechnic to the University of South Florida;
20 authorizing the Board of Trustees of the Florida
21 Polytechnic University to certify a direct-support
22 organization to serve the Florida Polytechnic
23 University; requiring that the Board of Trustees of
24 the University of South Florida and the University of
25 South Florida Foundation transfer to the new
26 foundation assets that were intended for the
27 University of South Florida Polytechnic; providing
28 that memorandums of understanding between the
29 University of South Florida and the University of
30 South Florida Polytechnic are invalid upon the act
31 becoming law; requiring that the University of South
32 Florida transfer the lease of certain federal
33 communications licenses and the proceeds from such
34 lease to the Florida Polytechnic University; requiring
35 the transfer of space at the Lakeland joint-use
36 facility to Polk State College when the Florida
37 Polytechnic University no longer needs the space;
38 requiring that the University of Florida be available
39 in an advisory or consulting capacity to assist the
40 Florida Polytechnic University; amending s. 1001.21,
41 F.S.; revising the definition of “state university” to
42 include the Florida Polytechnic University; amending
43 s. 1004.346, F.S.; revising provisions relating to the
44 Florida Industrial and Phosphate Research Institute,
45 to conform to changes made by the act; amending s.
46 1004.387, F.S.; providing for a doctor of pharmacy
47 degree program at the University of South Florida;
48 deleting provisions that authorize the development and
49 implementation of the program on the campus of the
50 University of South Florida Polytechnic; amending s.
51 1013.74, F.S.; authorizing a university board of
52 trustees to expend certain reserve or carry-forward
53 balances from prior years for capital outlay projects
54 for a new campus for specified fiscal years; providing
55 an appropriation; requiring that the Board of Trustees
56 of the Florida Polytechnic University provide written
57 certification to the Executive Office of the Governor
58 and the Board of Governors when certain conditions are
59 met; providing an effective date.

61 Be It Enacted by the Legislature of the State of Florida:
62
63 Section 1. Section 1004.345, Florida Statutes, is amended
64 to read:
65 (Substantial rewording of section. See
66 s. 1004.345, F.S., for present text.)
67 1004.345 The Florida Polytechnic University.—
68 (1) By December 31, 2016, the Florida Polytechnic
69 University shall meet the following criteria as established by
70 the Board of Governors:
71 (a) Achieve accreditation from the Commission on Colleges
72 of the Southern Association of Colleges and Schools;
73 (b) Initiate the development of the new programs in the
74 fields of science, technology, engineering, and mathematics;
75 (c) Seek discipline-specific accreditation for programs;
76 (d) Attain a minimum FTE of 1,244, with a minimum 50
77 percent of that FTE in the fields of science, technology,
78 engineering, and mathematics and 20 percent in programs related
79 to those fields;
80 (e) Complete facilities and infrastructure, including the
81 Science and Technology Building, Phase I of the Wellness Center,
82 the 70-bed modular resident hall, and the 120-bed residence
83 hall; and
84 (f) Have the ability to provide, either directly or where
85 feasible through a shared services model, administration of
86 financial aid, admissions, student support, information
87 technology, and finance and accounting with an internal audit
88 function.
89 (2) Once the criteria in subsection (1) have been met, the
90 Board of Trustees of the Florida Polytechnic University shall
91 notify the Board of Governors, and the Board of Governors shall
92 conduct a final review to confirm that the criteria have been
93 met.
94 (3) Students enrolled at the University of South Florida
95 Polytechnic shall be afforded the opportunity to complete their
96 degrees at the University of South Florida, subject to
97 university criteria.
98 Section 2. (1) All real and personal property, licenses and
99 associated revenues, existing contracts, and unexpended
100 balances, appropriations, allocations, and other funds of the
101 University of South Florida Polytechnic shall be transferred to
102 the Florida Polytechnic University.
103 (2) All programs, functions, offices, records, faculty
104 positions, and staff positions of the University of South
105 Florida Polytechnic shall be transferred to the University of
106 South Florida.
107 Section 3. In accordance with s. 1004.28, Florida Statutes,
108 and the regulations of the Board of Governors, the Board of
109 Trustees of the Florida Polytechnic University may certify a
110 direct-support organization to serve the Florida Polytechnic
111 University. The Board of Trustees of the University of South
112 Florida, in conjunction with the University of South Florida
113 Foundation, shall develop and implement a plan to transfer to
114 the new foundation assets derived from donations intended for
115 the enhancement of the University of South Florida Polytechnic.
116 Section 4. All memorandums of understanding between the
117 University of South Florida and the University of South Florida
118 Polytechnic and its successors shall be invalid upon this act
119 becoming a law.
120 Section 5. The University of South Florida shall transfer
121 the lease of federal communications licenses relating to Polk
122 County to the Florida Polytechnic University. All future
123 proceeds and any associated revenues from the lease of the
124 licenses shall accrue to the Florida Polytechnic University.
125 Section 6. The Florida Polytechnic University shall
126 transfer space at the Lakeland joint-use facility to Polk State
127 College as new space becomes available on the new campus of the
128 Florida Polytechnic University. Once the Florida Polytechnic
129 University has no further need for the space at the Lakeland
130 joint-use facility, the Florida Polytechnic University shall
131 complete the transfer of all remaining property and buildings of
132 the joint-use facility to Polk State College.
133 Section 7. The University of Florida, using its expertise
134 in the disciplines of science, technology, engineering, and
135 mathematics, shall be available in an advisory or consulting
136 capacity to assist the president and the Board of Trustees of
137 the Florida Polytechnic University in hiring, accreditation,
138 administration, and other areas.
139 Section 8. Paragraph (l) is added to subsection (6) of
140 section 1000.21, Florida Statutes, to read:
141 1000.21 Systemwide definitions.—As used in the Florida K-20
142 Education Code:
143 (6) “State university,” except as otherwise specifically
144 provided, includes the following institutions and any branch
145 campuses, centers, or other affiliates of the institution:
146 (l) The Florida Polytechnic University.
147 Section 9. Subsection (1), paragraph (b) of subsection (2),
148 and subsection (3) of section 1004.346, Florida Statutes, are
149 amended to read:
150 1004.346 Florida Industrial and Phosphate Research
151 Institute.—
152 (1) INSTITUTE CREATION.—The Florida Industrial and
153 Phosphate Research Institute is established within the Florida
154 Polytechnic University University of South Florida Polytechnic.
155 (2) PHOSPHATE RESEARCH AND ACTIVITIES BOARD.—The Phosphate
156 Research and Activities Board is created to monitor the
157 expenditure of funds appropriated to the university from the
158 Phosphate Research Trust Fund.
159 (b) The board shall consist of five members. The Governor
160 shall appoint two persons representing the phosphate mining or
161 processing industry and one member representing a major
162 environmental conservation group in the state. The Secretary of
163 Environmental Protection or his or her designee and the
164 President Campus Executive Officer of the Florida Polytechnic
165 University University of South Florida Polytechnic shall also
166 serve as board members.
167 (3) INSTITUTE EXECUTIVE DIRECTOR.—An executive director
168 shall be designated by and serve at the pleasure of the
169 President Campus Executive Officer of the Florida Polytechnic
170 University University of South Florida Polytechnic or his or her
171 designee. The executive director shall be responsible for the
172 daily administration of the institute, including the expenditure
173 of funds from all sources. The executive director shall consult
174 with the Phosphate Research and Activities Board on the projects
175 that the institute expects to undertake using moneys
176 appropriated from the Phosphate Research Trust Fund.
177 Section 10. Section 1004.387, Florida Statutes, is amended
178 to read:
179 1004.387 Doctor of pharmacy degree program at the
180 University of South Florida.—A doctor of pharmacy degree program
181 is authorized at the University of South Florida. The program
182 shall be physically located on the new campus of the University
183 of South Florida Polytechnic. The university is authorized to
184 develop and implement the program within existing facilities
185 only until the construction of a pharmacy facility on the new
186 campus of the University of South Florida Polytechnic is
187 completed, which shall house the doctor of pharmacy degree
188 program.
189 Section 11. Subsection (6) is added to section 1013.74,
190 Florida Statutes, to read:
191 1013.74 University authorization for fixed capital outlay
192 projects.—
193 (6) For the 2011-2012 through 2022-2023 fiscal years, a
194 university board of trustees may expend reserve or carry-forward
195 balances from prior year operational and programmatic
196 appropriations for legislatively approved fixed capital outlay
197 projects authorized for the establishment of a new campus.
198 Section 12. The sum of $25 million in recurring funds from
199 the General Revenue Fund is appropriated to the University of
200 South Florida for the purpose of implementing this act. The
201 funds shall be held in budget reserve by the Executive Office of
202 the Governor until the provisions in sections 2, 3, and 5 of
203 this act have been satisfied. The Board of Trustees of the
204 Florida Polytechnic University shall provide written
205 certification to the Executive Office of the Governor and the
206 Board of Governors when the provisions in sections 2, 3, and 5
207 of this act have been satisfied.
208 Section 13. This act shall take effect upon becoming a law.
