A bill to be entitled
2An act relating to electric energy production;
3amending s. 366.02, F.S.; revising the definition of
4the term "public utility" to exclude certain renewable
5solar energy production facilities for purposes of
6specified provisions; amending s. 366.91, F.S.;
7revising the definition of the term "net metering" for
8purposes of provisions relating to renewable energy;
9providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Subsection (1) of section 366.02, Florida
14Statutes, is amended to read:
15     366.02  Definitions.-As used in this chapter:
16     (1)  "Public utility" means every person, corporation,
17partnership, association, or other legal entity and their
18lessees, trustees, or receivers supplying electricity or gas
19(natural, manufactured, or similar gaseous substance) to or for
20the public within this state; but the term "public utility" does
21not include either a cooperative now or hereafter organized and
22existing under the Rural Electric Cooperative Law of the state;
23a municipality or any agency thereof; an entity that produces
24and sells 5 megawatts or less per hour of renewable solar
25energy, as defined in s. 377.803(6), to users located on the
26property adjacent to or contiguous with the renewable energy
27production facility; any dependent or independent special
28natural gas district; any natural gas transmission pipeline
29company making only sales or transportation delivery of natural
30gas at wholesale and to direct industrial consumers; any entity
31selling or arranging for sales of natural gas which neither owns
32nor operates natural gas transmission or distribution facilities
33within the state; or a person supplying liquefied petroleum gas,
34in either liquid or gaseous form, irrespective of the method of
35distribution or delivery, or owning or operating facilities
36beyond the outlet of a meter through which natural gas is
37supplied for compression and delivery into motor vehicle fuel
38tanks or other transportation containers, unless such person
39also supplies electricity or manufactured or natural gas.
40     Section 2.  Paragraph (c) of subsection (2) of section
41366.91, Florida Statutes, is amended to read:
42     366.91  Renewable energy.-
43     (2)  As used in this section, the term:
44     (c)  "Net metering" means a metering and billing
45methodology whereby customer-owned renewable generation is
46allowed to offset the customer's electricity consumption on
47site, and the customer's site includes all of the customer's
48energy usage accounts located on contiguous property owned by
49the same customer.
50     Section 3.  This act shall take effect July 1, 2012.
