       Senator Siplin moved the following:
       
    1         Senate Amendment to Amendment (109490) (with title
    2  amendment)

    4         Between lines 1141 and 1142
    5  insert:
    6         Section 34. Subsection (1) of section 83.42, Florida
    7  Statutes, is amended to read:
    8         83.42 Exclusions from application of part.—This part does
    9  not apply to:
   10         (1) Residency or detention in a facility, whether public or
   11  private, when residence or detention is incidental to the
   12  provision of medical, geriatric, educational, counseling,
   13  religious, or similar services. For residents of a facility
   14  licensed under part II of chapter 400, the provisions of s.
   15  400.0255 are the exclusive procedures for all transfers and
   16  discharges.
   17         Section 35. Subsection (27) of section 400.462, Florida
   18  Statutes, is amended to read:
   19         400.462 Definitions.—As used in this part, the term:
   20         (27) “Remuneration” means any payment or other benefit made
   21  directly or indirectly, overtly or covertly, in cash or in kind.
   22  However, if the term is used in any provision of law relating to
   23  health care providers, the term does not apply to an item that
   24  has an individual value of up to $15, including, but not limited
   25  to, a plaque, a certificate, a trophy, or a novelty item that is
   26  intended solely for presentation or is customarily given away
   27  solely for promotional, recognition, or advertising purposes.
   28         Section 36. Paragraph (c) of subsection (1) of section
   29  408.037, Florida Statutes, is amended to read:
   30         408.037 Application content.—
   31         (1) Except as provided in subsection (2) for a general
   32  hospital, an application for a certificate of need must contain:
   33         (c) An audited financial statement of the applicant or the
   34  applicant’s parent corporation if audited financial statements
   35  of the applicant do not exist. In an application submitted by an
   36  existing health care facility, health maintenance organization,
   37  or hospice, financial condition documentation must include, but
   38  need not be limited to, a balance sheet and a profit-and-loss
   39  statement of the 2 previous fiscal years’ operation.
   40         Section 37. Subsection (2) of section 468.1695, Florida
   41  Statutes, is amended to read:
   42         468.1695 Licensure by examination.—
   43         (2) The department shall examine each applicant who the
   44  board certifies has completed the application form and remitted
   45  an examination fee set by the board not to exceed $250 and who:
   46         (a)1. Holds a baccalaureate degree from an accredited
   47  college or university and majored in health care administration,
   48  health services administration, or an equivalent major, or has
   49  credit for at least 60 semester hours in subjects, as prescribed
   50  by rule of the board, which prepare the applicant for total
   51  management of a nursing home; and
   52         2. Has fulfilled the requirements of a college-affiliated
   53  or university-affiliated internship in nursing home
   54  administration or of a 1,000-hour nursing home administrator-in
   55  training program prescribed by the board; or
   56         (b)1. Holds a baccalaureate degree from an accredited
   57  college or university; and
   58         2.a. Has fulfilled the requirements of a 2,000-hour nursing
   59  home administrator-in-training program prescribed by the board;
   60  or
   61         b. Has 1 year of management experience allowing for the
   62  application of executive duties and skills, including the
   63  staffing, budgeting, and directing of resident care, dietary,
   64  and bookkeeping departments within a skilled nursing facility,
   65  hospital, hospice, assisted living facility with a minimum of 60
   66  licensed beds, or geriatric residential treatment program and,
   67  if such experience is not in a skilled nursing facility, has
   68  fulfilled the requirements of a 1,000-hour nursing home
   69  administrator-in-training program prescribed by the board.

   83         exclude items having a value of $15 or less; amending

   85         financial information to be included in an application
   86         for a certificate of need; amending s. 468.1695, F.S.;
   87         providing that a health services administration or an
   88         equivalent major satisfies the education requirements
