    1                        A bill to be entitled                      
    2         An act relating to designation of transportation
    3         facilities; amending s. 334.071, F.S.; limiting the
    4         designation of transportation facilities to facilities
    5         of the State Highway System; requiring that a natural
    6         person must have significantly contributed to the
    7         state or community in order to warrant legislative
    8         recognition; providing criteria for designating a
    9         transportation facility; providing a limitation for
   10         the expenditure of funds for costs relating to a
   11         designation; providing an effective date.

   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Section 334.071, Florida Statutes, is amended to
   16  read:
   17         334.071 Legislative designation of transportation
   18  facilities.—
   19         (1) Designation of a transportation facility contained in
   20  an act of the Legislature is for honorary or memorial purposes
   21  or to distinguish a particular facility, and unless specifically
   22  provided for, does shall not be construed to require any action
   23  by a local government or private party regarding the changing of
   24  any street signs, mailing address, or 911 emergency telephone
   25  number system listing. Such designations are limited to
   26  transportation facilities on the State Highway System.
   27         (2) A transportation facility may not be designated in
   28  honor of a natural person unless that natural person has made a
   29  significant contribution to the state or local community in
   30  civic, business, public service, or other pursuits.
   31         (3) The erection of markers may not violate sign spacing
   32  requirements of the Manual on Uniform Traffic Control Devices
   33  adopted pursuant to s. 316.0745, limit or obscure the visibility
   34  of an official traffic control device, or generate a distraction
   35  for a driver.
   36         (4)(2) The effect of such designations requires shall only
   37  be construed to require the placement of markers by the
   38  department only at the termini or intersections specified for
   39  each highway segment or bridge designated, and authorizes as
   40  authority for the department to place other markers as
   41  appropriate for the transportation facility being designated.
   42  The department shall expend funds solely for the costs
   43  associated with fabrication and installation of markers,
   44  including routine maintenance and replacement costs.
   45         (5)(3) Erection of markers is shall be contingent on the
   46  appropriate city or county commission passing a resolution in
   47  support of the particular honorary designation. If the bridge or
   48  road segment being designated is located in more than one city
   49  or county, resolutions supporting the designation must be passed
   50  by each affected local government prior to the erection of the
   51  markers.
   52         Section 2. This act shall take effect July 1, 2012.
