The Committee on Community Affairs (Bennett) recommended the
following:
1 Senate Amendment (with title amendment)

4 insert:
5 Section 2. Broadcast blackouts prohibited at publicly
6 financed facilities.—
7 (1) A new or retained professional sports franchise using a
8 facility that receives public funding under s. 212.20(6)(d)6.,
9 Florida Statutes, or the franchise’s league may not prohibit
10 television or radio broadcasts of a game played in the facility
11 in areas near the facility due to insufficient ticket sales.
12 (2) If the professional sports franchise or its league
13 violates this section, the professional sports franchise is
14 subject to a fine by the county in which the facility is located
15 in the amount of $125,000 per violation. A fine assessed under
16 this section must be paid by the franchise before it plays the
17 first regular season game of the next season in the publicly
18 financed facility.
19 (3) The proceeds of the fine shall be used by the county or
20 the public sports authority for the county exclusively to
21 purchase tickets to games of the professional sports franchise
22 at the facility for foster children and their foster families,
23 nonprofit youth organizations, and the United Service
24 Organization, Inc., which organization will provide the tickets
25 to servicemembers on leave from active duty in a combat zone and
26 their families.

32 and county are operating a homeless shelter; prohibiting a
33 new or retained professional sport franchise that uses a
34 facility that receives certain distributions of public funds or
35 the franchise’s league from preventing television or radio
36 broadcasts of games in the facility due to insufficient ticket
37 sales; providing that the sports franchise is subject to a fine
38 by the county in which the facility is located if broadcasts of
39 a game are prohibited; requiring that the proceeds of the fine
40 be used to purchase tickets to games of the sports franchise at
41 the publicly financed facility for specified individuals and
42 their families; providing
