       The Committee on Environmental Preservation and Conservation
       (Dean) recommended the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 239 - 246
    4  and insert:
    5         (b) Notwithstanding the provisions of this section, a
    6  governmental entity may not create or provide mitigation for a
    7  project other than its own unless the governmental entity uses
    8  land that was not previously purchased for conservation and
    9  unless the governmental entity provides the same financial
   10  assurances as required for mitigation banks permitted under s.
   11  373.4136. This paragraph does not apply to:
