A bill to be entitled
2An act relating to the City of Clearwater, Pinellas
3County; authorizing the Division of Alcoholic
4Beverages and Tobacco of the Department of Business
5and Professional Regulation to issue up to a specified
6number of temporary permits to a nonprofit civic
7organization to sell alcoholic beverages for
8consumption on the premises at outdoor events on
9public right-of-way and public park property in the
10downtown area of Clearwater; providing that such
11events require a special event permit from the City of
12Clearwater; providing that the permits authorized by
13the act are in addition to certain other authorized
14temporary permits; requiring the nonprofit civic
15organization to comply with certain statutory
16requirements in obtaining the permits authorized by
17the act; requiring the division to adopt rules;
18providing an effective date.

20Be It Enacted by the Legislature of the State of Florida:

22     Section 1.  (1)  Notwithstanding any other provision of
23law, the Division of Alcoholic Beverages and Tobacco of the
24Department of Business and Professional Regulation may issue to
25a bona fide nonprofit civic organization, upon application and
26presentation of a valid special event permit issued by the City
27of Clearwater, a temporary permit authorizing the sale of
28alcoholic beverages for consumption on the premises at outdoor
29events on public right-of-way and public park property in the
30downtown area of Clearwater. Any such nonprofit civic
31organization may be issued up to 15 temporary permits per
32calendar year and each temporary permit is valid for up to 3
33days. For purposes of this act, the downtown area of Clearwater
34is that area between Drew Street and Pierce Street North and
35South and between Myrtle Street and the waterfront.
36     (2)  The temporary permits authorized by this act are in
37addition to the three temporary permits authorized per year for
38a nonprofit civic organization pursuant to section 561.422,
39Florida Statutes.
40     (3)  The nonprofit civic organization shall comply with all
41other requirements of section 561.422, Florida Statutes, in
42obtaining the temporary permits authorized by this act.
43     (4)  Upon this act becoming a law, the Division of
44Alcoholic Beverages and Tobacco of the Department of Business
45and Professional Regulation shall adopt rules pursuant to
46chapter 120, Florida Statutes, to administer this act. Such
47rules shall include permitting procedures and application forms.
48     Section 2.  This act shall take effect upon becoming a law.
