House Comm: RCS . 02/16/2012 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Governmental Oversight and Accountability (Benacquisto) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 59 - 222 4 and insert: 5 personnel of the Department of Revenue, county tax collectors, 6 or local governments whose responsibilities include revenue 7 collection and enforcement or child support enforcement; the 8 home addresses, telephone numbers, social security numbers, 9 photographs, and places of employment of the spouses and 10 children of such personnel; and the names and locations of 11 schools and day care facilities attended by the children of such 12 personnel are exempt from s. 119.07(1). This sub-subparagraph is 13 subject to the Open Government Sunset Review Act in accordance 14 with s. 119.15 and shall stand repealed on October 2, 2017, 15 unless reviewed and saved from repeal through reenactment by the 16 Legislature. 17 b. The home addresses, telephone numbers, and photographs 18 of firefighters certified in compliance with s. 633.35; the home 19 addresses, telephone numbers, photographs, and places of 20 employment of the spouses and children of such firefighters; and 21 the names and locations of schools and day care facilities 22 attended by the children of such firefighters are exempt from s. 23 119.07(1). 24 c. The home addresses and telephone numbers of justices of 25 the Supreme Court, district court of appeal judges, circuit 26 court judges, and county court judges; the home addresses, 27 telephone numbers, and places of employment of the spouses and 28 children of justices and judges; and the names and locations of 29 schools and day care facilities attended by the children of 30 justices and judges are exempt from s. 119.07(1). 31 d. The home addresses, telephone numbers, social security 32 numbers, and photographs of current or former state attorneys, 33 assistant state attorneys, statewide prosecutors, or assistant 34 statewide prosecutors; the home addresses, telephone numbers, 35 social security numbers, photographs, and places of employment 36 of the spouses and children of current or former state 37 attorneys, assistant state attorneys, statewide prosecutors, or 38 assistant statewide prosecutors; and the names and locations of 39 schools and day care facilities attended by the children of 40 current or former state attorneys, assistant state attorneys, 41 statewide prosecutors, or assistant statewide prosecutors are 42 exempt from s. 119.07(1) and s. 24(a), Art. I of the State 43 Constitution. 44 e. The home addresses and telephone numbers of general 45 magistrates, special magistrates, judges of compensation claims, 46 administrative law judges of the Division of Administrative 47 Hearings, and child support enforcement hearing officers; the 48 home addresses, telephone numbers, and places of employment of 49 the spouses and children of general magistrates, special 50 magistrates, judges of compensation claims, administrative law 51 judges of the Division of Administrative Hearings, and child 52 support enforcement hearing officers; and the names and 53 locations of schools and day care facilities attended by the 54 children of general magistrates, special magistrates, judges of 55 compensation claims, administrative law judges of the Division 56 of Administrative Hearings, and child support enforcement 57 hearing officers are exempt from s. 119.07(1) and s. 24(a), Art. 58 I of the State Constitution if the general magistrate, special 59 magistrate, judge of compensation claims, administrative law 60 judge of the Division of Administrative Hearings, or child 61 support hearing officer provides a written statement that the 62 general magistrate, special magistrate, judge of compensation 63 claims, administrative law judge of the Division of 64 Administrative Hearings, or child support hearing officer has 65 made reasonable efforts to protect such information from being 66 accessible through other means available to the public. This 67 sub-subparagraph is subject to the Open Government Sunset Review 68 Act in accordance with s. 119.15, and shall stand repealed on 69 October 2, 2013, unless reviewed and saved from repeal through 70 reenactment by the Legislature. 71 f. The home addresses, telephone numbers, and photographs 72 of current or former human resource, labor relations, or 73 employee relations directors, assistant directors, managers, or 74 assistant managers of any local government agency or water 75 management district whose duties include hiring and firing 76 employees, labor contract negotiation, administration, or other 77 personnel-related duties; the names, home addresses, telephone 78 numbers, and places of employment of the spouses and children of 79 such personnel; and the names and locations of schools and day 80 care facilities attended by the children of such personnel are 81 exempt from s. 119.07(1) and s. 24(a), Art. I of the State 82 Constitution. 83 g. The home addresses, telephone numbers, and photographs 84 of current or former code enforcement officers; the names, home 85 addresses, telephone numbers, and places of employment of the 86 spouses and children of such personnel; and the names and 87 locations of schools and day care facilities attended by the 88 children of such personnel are exempt from s. 119.07(1) and s. 89 24(a), Art. I of the State Constitution. 90 h. The home addresses, telephone numbers, places of 91 employment, and photographs of current or former guardians ad 92 litem, as defined in s. 39.820; the names, home addresses, 93 telephone numbers, and places of employment of the spouses and 94 children of such persons; and the names and locations of schools 95 and day care facilities attended by the children of such persons 96 are exempt from s. 119.07(1) and s. 24(a), Art. I of the State 97 Constitution, if the guardian ad litem provides a written 98 statement that the guardian ad litem has made reasonable efforts 99 to protect such information from being accessible through other 100 means available to the public. This sub-subparagraph is subject 101 to the Open Government Sunset Review Act in accordance with s. 102 119.15 and shall stand repealed on October 2, 2015, unless 103 reviewed and saved from repeal through reenactment by the 104 Legislature. 105 i. The home addresses, telephone numbers, and photographs 106 of current or former juvenile probation officers, juvenile 107 probation supervisors, detention superintendents, assistant 108 detention superintendents, juvenile justice detention officers I 109 and II, juvenile justice detention officer supervisors, juvenile 110 justice residential officers, juvenile justice residential 111 officer supervisors I and II, juvenile justice counselors, 112 juvenile justice counselor supervisors, human services counselor 113 administrators, senior human services counselor administrators, 114 rehabilitation therapists, and social services counselors of the 115 Department of Juvenile Justice; the names, home addresses, 116 telephone numbers, and places of employment of spouses and 117 children of such personnel; and the names and locations of 118 schools and day care facilities attended by the children of such 119 personnel are exempt from s. 119.07(1) and s. 24(a), Art. I of 120 the State Constitution. 121 j. The home addresses, telephone numbers, and photographs 122 of current or former public defenders, assistant public 123 defenders, criminal conflict and civil regional counsel, and 124 assistant criminal conflict and civil regional counsel; the home 125 addresses, telephone numbers, and places of employment of the 126 spouses and children of such defenders or counsel; and the names 127 and locations of schools and day care facilities attended by the 128 children of such defenders or counsel are exempt from s. 129 119.07(1) and s. 24(a), Art. I of the State Constitution. This 130 sub-subparagraph is subject to the Open Government Sunset Review 131 Act in accordance with s. 119.15 and shall stand repealed on 132 October 2, 2015, unless reviewed and saved from repeal through 133 reenactment by the Legislature. 134 k. The home addresses, telephone numbers, and photographs 135 of current or former investigators or inspectors of the 136 Department of Business and Professional Regulation; the names, 137 home addresses, telephone numbers, and places of employment of 138 the spouses and children of such current or former investigators 139 and inspectors; and the names and locations of schools and day 140 care facilities attended by the children of such current or 141 former investigators and inspectors are exempt from s. 119.07(1) 142 and s. 24(a), Art. I of the State Constitution if the 143 investigator or inspector has made reasonable efforts to protect 144 such information from being accessible through other means 145 available to the public. This sub-subparagraph is subject to the 146 Open Government Sunset Review Act in accordance with s. 119.15 147 and shall stand repealed on October 2, 2017, unless reviewed and 148 saved from repeal through reenactment by the Legislature. 149 2. An agency that is the custodian of the information 150 specified in subparagraph 1. and that is not the employer of the 151 officer, employee, justice, judge, or other person specified in 152 subparagraph 1. shall maintain the exempt status of that 153 information only if the officer, employee, justice, judge, other 154 person, or employing agency of the designated employee submits a 155 written request for maintenance of the exemption to the 156 custodial agency. 157 Section 2. The Legislature finds that it is a public 158 necessity that the home addresses, telephone numbers, and 159 photographs of personnel of county tax collectors whose 160 responsibilities include revenue collection and enforcement or 161 child support enforcement, the names, home addresses, telephone 162 numbers, and places of employment of the spouses and children of 163 such personnel, and the names and locations of schools and day 164 care facilities attended by the children of such personnel be 165 made exempt from public records requirements. It is also the 166 finding of the Legislature that it is a public necessity that 167 the home addresses, telephone numbers, and photographs of 168 current and former investigators and inspectors of the 169 Department of Business and Professional Regulation, the names, 170 home addresses, telephone numbers, and places of employment of 171 the spouses and children of such current or former investigators 172 and inspectors, and the names and locations of schools and day 173 care facilities attended by the children of such current or 174 former investigators and inspectors be made exempt from public 175 records requirements. The Legislature finds that the release of 176 such identifying and location information might place personnel 177 of county tax collectors and investigators and inspectors of the 178 Department of Business and Professional Regulation and their 179 family members in danger of physical and emotional harm from 180 disgruntled individuals who have contentious reactions to 181 revenue collection or enforcement actions or child support 182 enforcement actions of a county tax collector, or whose business 183 or professional practices have come under the scrutiny of 184 investigators and inspectors of the Department of Business and 185 Professional Regulation.
