       The Committee on Criminal Justice (Smith) recommended the
       following:
       
    1         Senate Amendment to Amendment (664734) (with title
    2  amendment)
    3  
    4         Delete line 52
    5  and insert:
    6         Section 2. A person may apply to the Department of Law
    7  Enforcement for a certificate of eligibility to expunge or seal
    8  his or her criminal history record pursuant to s. 943.0585 or s.
    9  943.059, Florida Statutes, respectively, if the person has been
   10  found guilty of, regardless of adjudication, has entered a plea
   11  of nolo contendere or guilty to, or has been adjudicated
   12  delinquent for any of the following traffic violations:
   13         (1) For a nongovernmental entity, using a traffic control
   14  device at any place where the general public is invited which
   15  does not conform to the uniform system of traffic control
   16  devices adopted by the Department of Transportation in violation
   17  of s. 316.0747, Florida Statutes.
   18         (2)Failing to properly immobilize a vehicle according to
   19  law in violation of s. 316.193(13)(c), Florida Statutes.
   20         (3)Obstructing the free, convenient, and normal use of any
   21  public street, highway, or road in order to solicit in violation
   22  of s. 316.2045(2), Florida Statutes.
   23         (4)Selling or installing sunscreening material in
   24  violation of s. 316.2956(3), Florida Statutes.
   25         (5) For the owner of a motor vehicle registered in the
   26  state, failing to notify the Department of Highway Safety and
   27  Motor Vehicles in writing of a change of address within 20 days
   28  of such change in violation of s. 320.02(4), Florida Statutes.
   29         (6)Failing to timely register a motor vehicle or mobile
   30  home in violation of s. 320.07(3)(c), Florida Statutes.
   31         (7) Failing to abide by the requirements applicable for
   32  placing a license plate on a moped in violation of s. 320.0803,
   33  Florida Statutes.
   34         (8) Committing a misdemeanor in violation of any provision
   35  of chapter 322, Florida Statutes, unless the offense is declared
   36  to be otherwise by chapter 322, Florida Statutes, or other law
   37  of this state in violation of s. 322.39, Florida Statutes.
   38         Section 3. This act shall take effect October 1, 2012.

   41         And the title is amended as follows:
   42         Delete lines 60 - 70
   43  and insert:
   44         An act relating to expunging or sealing certain
   45         criminal history records; amending s. 943.0582, F.S.;
   46         allowing minors who have certain felony arrests to
   47         have the Department of Law Enforcement expunge their
   48         nonjudicial arrest record upon successful completion
   49         of a prearrest or postarrest diversion program;
   50         extending the application submission period for minors
   51         who have successfully completed a prearrest or
   52         postarrest diversion program; extending the
   53         application submission date for minors who completed
   54         the program before a certain date; authorizing a
   55         person to apply to the Department of Law Enforcement
   56         for a certificate of eligibility to expunge or seal
   57         his or her criminal history record for certain
   58         specified traffic violations; providing an effective
   59         date.
