    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating s. 766.4105,
    3         F.S.; creating the Patient Compensation System Trust
    4         Fund within the State Treasury; providing for the
    5         purpose and source of the trust fund; providing for
    6         future review and termination or re-creation of the
    7         trust fund; providing a contingent effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Section 766.4105, Florida Statutes, is created
   12  to read:
   13         766.4105 Patient Compensation System Trust Fund.—
   14         (1) There is created within the State Treasury the “Patient
   15  Compensation System Trust Fund,” which shall be used in the
   16  operation of the Patient Compensation System as required under
   17  this part.
   18         (2) The trust fund is established for the deposit of
   19  contributions required to be paid by providers pursuant to s.
   20  766.408. Notwithstanding s. 216.301 and pursuant to s. 216.351,
   21  any balance in the trust fund at the end of any fiscal year
   22  shall remain in the trust fund at the end of the year and shall
   23  be available for carrying out the purposes of the trust fund.
   24         (3) In accordance with s. 19(f)(2), Art. III of the State
   25  Constitution, the trust fund shall, unless terminated sooner, be
   26  terminated on July 1, 2017. Before its scheduled termination,
   27  the trust fund shall be reviewed as provided in s. 215.3206(1)
   28  and (2).
   29         Section 2. This act shall take effect on the same date that
   30  SB ____ or similar legislation takes effect, if such legislation
   31  is enacted in the same legislative session or an extension
   32  thereof and becomes law, and only if this act is enacted by a
   33  three-fifths vote of the membership of each house of the
   34  Legislature.
