Floor: 1a/AD/2R . 04/26/2013 12:08 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Gardiner moved the following: 1 Senate Amendment to Amendment (573240) 2 3 Delete lines 13 - 38 4 and insert: 5 or an alternate assessment pursuant to s. 1008.22(3)(c) are not 6 offered to a student during the current year’s assessment 7 administration due to technological limitations in the testing 8 administration program which lead to results that reflect the 9 student’s impaired sensory, manual, or speaking skills rather 10 than the student’s achievement of the benchmarks assessed by the 11 statewide standardized assessment, a statewide standardized end 12 of-course assessment, or an alternate assessment. 13 (b) “Condition” means an impairment, whether recently 14 acquired or longstanding, which affects a student’s ability to 15 communicate in modes deemed acceptable for statewide 16 assessments, even if appropriate accommodations are provided, 17 and creates a situation in which the results of administration 18 of the statewide standardized assessment, an end-of-course 19 assessment, or an alternate assessment would reflect the 20 student’s impaired sensory, manual, or speaking skills rather 21 than the student’s achievement of the benchmarks assessed by the 22 statewide standardized assessment, a statewide standardized end 23 of-course assessment, or an alternate assessment. 24 (2) A student with a disability for whom the individual 25 education plan (IEP) team determines is prevented by a 26 circumstance or condition from physically demonstrating the 27 mastery of skills that have been acquired and are measured by 28 the statewide standardized assessment, a statewide standardized 29 end-of-course assessment, or an alternate assessment pursuant to 30 s. 1008.22(3)(c) shall be granted an extraordinary exemption
